Is it legal to cut someones plants if they grow on your property?

Say hypothetically someone grows legal medical weed on your property and pays rent to use the land. If they don't pay you what can you do?

You must go thru with a eviction process , details vary by location

But generaly once their paid time is over their is stuff you can do to move them along faster , like shut the gas/oil and hot water off , but whatever you do you cant create a safty or sanitary issue's

Ask them to leave. If they don't (30 days I think), you can evict them. If they are growing it inside, nothing you can or should do on that alone. If they are growing outside on your property, I'd give them one warning to remove it with a days notice. Then rip it yourself or turn them in. BTW, that is not the way we should be talking to new members. Totally unnecessary. Peace

Actually you need to start the eviction process ASAP, becouse the day amount starts once the paperwork is filled out and filled ,,not once he misses a payment . And most sherifs (the guys the usually do the eviction) are backloged you could wait a very long time for a eviction, their are private companys that will do it thow (most places) but it's not cheap.


I would look very closely at your states medical laws concerning home grows , and the lease aggrement . Since the former renter is now leagly squating he has very limited 'renters rights'. I would not be surprized at all if you could leagly rip up his grow since it's now 'technicaly' yours

I know some people will highly disagre with this but ........

Talk to the police or local sherif about what you can do or get away with / Just dont do it while high or with stuff in your pockets. Most will be very happy to talk and will tell you exactly what you can or can not do

Thanks for the replies. I should have given more information. We are land lords and the growers (out door) compensate us for the land use. They have not paid since the last grow season. The compensation to land owners for the use of their land regarding medical growing is not clear by law. I don't think its legal. Local authorities will not be able to help and there is no 'lease agreement' for the property. Its totally fucked, this is what happens when laws are not well established. People get taken advantage of.

So what do I do?

in your case, you retain the bond, you do have a bond (a months rent in advance?) don't you ..??? the weed ain't yours, but if you sell the weed to recover the lost cash is a very wrong approach see a lawyer

Also for being out door grow it would really depend on the state you live in if it was legal at all.... I know Michigan all legal medical grows have to be indoors and in a room that has a locked door.... a friend of mine had what he thought was a legal outdoor grow but found out it wasn't with a huge fine and plants your up by staties...

Thanks for clearing the issue up for all Lang. In your case, since you own the land and accept payments in product, I would go and "pick" my rent off of my land. Probably not a real good way to do business. Good luck. Peace

I can understand your point of cutting it. So many illegal growers out there simply make homes rental properties uninhabitable. It's idiots like that that make owners want their investment. I say if you have the balls to rent property grow anything on it and can't pay. Then I say file your paperwork get him evicted. I don't think it's good to destroy people's items no matter what it is. I feel your pain though

Thank you everyone for the comments. The trouble is, that they have plants in the ground now yet have not compensated us since last year. In this situation the land owner is powerless because he or she has no leverage what so ever. How can you make them pay? I'm not gangster. This it middle class america. I think the best call is to wait till their plants are firm in the ground then tell them to pay or move them. Then they lose crop yield for having to move them due to shock and other potential harm to the plants. It will be in their interest to pay.

Thoughts?

You should have had a lease or at least some sort of written agreement that protects you both. On the upside without a lease he has no right to be on your property and you can kick him off whenever you want.
tell him to pay up or move on.
you don't have to cut his plants down you can easily just poison them.

What do you do?

How about talk to them about the issue, or hell, put something in writing at least.

While some can't, MOST people can be reasonable, given the chance.

I hope your making darn sure of whats legal and whats not in your state. There just might be illegal product and its growing on YOUR land. Sure, it belongs to your tenant but it could be a big headache for you as well. You need to see a good lawyer well versed in the laws of your state.
