Trump fights claims he misled attorney as court weighs effort to force testimony
Former President Trump railed against reports he misled the attorney representing him in the Mar-a-Lago probe as a court set a series of overnight deadlines in a battle to determine whether the attorney must testify in the investigation.

ABC News reported Tuesday that D.C. District Court Judge Beryl Howell found sufficient evidence that Trump may have intentionally concealed the existence of additional classified records held at his Florida home from his attorney Evan Corcoran.

Howell, in a sealed ruling that served as her final before stepping down as chief judge, ordered Corcoran to testify in the probe, determining that the Justice Department had presented sufficient evidence that his legal advice may have been in furtherance of a crime — igniting the crime fraud exception that allows the piercing of attorney-client privilege.

An appeal now rests before a three-judge panel at the D.C. Circuit Court of Appeals, which late Tuesday set a series of rapid-fire deadlines on the matter. The Trump team was required to submit a brief at midnight, with DOJ’s response due by 6 a.m. Wednesday.
Trump late Tuesday attacked the article without addressing the specifics of ABC’s story.

“Shame on Fake News ABC for broadcasting ILLEGALLY LEAKED false allegations from a Never Trump, now former chief judge, against the Trump legal team,” the Trump campaign said in a statement that went on to bash the Mueller report.

According to ABC, Howell ordered Corcoran to testify on several lines of inquiry where he refused to answer questions from prosecutors before a grand jury citing attorney-client privilege. She also ordered him to turn over handwritten notes, invoices and transcripts of audio recordings.

Corcoran’s testimony could be key for the investigation of special counsel Jack Smith. It was Corcoran who in June turned over 38 additional records to prosecutors after DOJ issued a subpoena for any remaining documents bearing classified markings. He also reportedly drafted a statement saying all classified records had been returned but turned the certification over to another attorney to sign.

In an August search, authorities would find another 100 classified records on the property.
The matter now before the appeals court remains under seal, but a decision could come as soon as Wednesday morning.
Trump is also facing a potential decision from a New York grand jury, which meets again Wednesday and is weighing evidence presented in Manhattan District Attorney Alvin Bragg’s (D) investigation into hush money payments.

Appeals court backs DOJ, forcing Trump attorney to aid documents probe
An appeals court on Wednesday rejected attempts by former President Trump’s legal team to challenge a Friday ruling ordering his attorney Evan Corcoran to produce documents related to the probe into the potential mishandling of records at Mar-a-Lago.

A three-judge panel for the D.C. Circuit Court of Appeals sided with special counsel Jack Smith and backed a lower court judge who on Friday issued a sealed ruling directing Corcoran to cooperate on several lines of inquiry he had rebuffed, citing attorney-client privilege.

In that opinion, D.C. District Court Judge Beryl Howell determined that the Justice Department had presented sufficient evidence that his legal advice may have been in furtherance of a crime — igniting the crime fraud exception that allows the piercing of attorney-client privilege.

The appeal by Trump’s team follows reporting from ABC News indicating that Trump may have intentionally concealed from Corcoran the existence of additional classified records held at his Florida home.

According to ABC, Howell’s ruling compelled Corcoran to testify along six lines of inquiry where Cocoran declined to answer questions in a prior appearance before a grand jury. She also compelled him to produce documents, notes, invoices and even transcripts or audio recordings related to the case, which she at one point referred to as a criminal scheme

Trump’s team did not immediately respond to request for comment, but previously pushed back on ABC’s story, dismissing it as “illegally leaked.”

Wednesday’s decision comes from three Obama appointees. Though publicly docketed, the arguments from both Trump’s team and the Justice Department are under seal.

Any further challenge from Trump would fall before the Supreme Court.

Corcoran’s testimony could be key to the Mar-a-Lago investigation.

He also reportedly drafted a statement saying all classified records had been returned but turned the certification over to another attorney to sign.

Renato Mariotti, a former federal prosecutor, wrote on Twitter that testimony from Corcoran “could lead to further piercing of privileged conversations.”

“The more important piece of evidence ordered by the Judge is ‘transcriptions of personal audio recordings.’ This suggests that Corcoran may have recorded conversations with Trump, his client,” Mariotti wrote.

“Regardless of who he recorded, the Judge found that those recorded conversations constitute evidence of what she called Trump’s ‘criminal scheme.’ That could be extremely powerful and important evidence.”

It's gonna come down to the violent insurrectionist vs. the volunteer torturer's attorney for the GOP finale. No reason to be concerned...?

Both sides are not the same and their respective sympathetic press corps are not the same.

When the GOP went off this same deep end in the 1950's with the John Birchers, the Red Scare and Joe McCarthy, WWII vets were aware of their role in protecting democracy from fascism and shut the worst aspirations of the right wing down. The GOP has now lost their way as their WWII veteran members passed on. Their guiding light to respect democracy is now gone and what is left are the worst characteristics of conservatism.
