Got this email from my lawyer today although i dont live in boulder some of you do so I tough Id pass it on to you all:

Dear Friends,

For those of you with MMCs, MIPs, and/or OPCs in the City of Boulder, be advised that the inspection process is underway. I apologize if you do not fit into this category and are receiving this email (I don't segregate our email database by City or County). If you know someone who may be affected by this information, kindly pass this email onto them.

In any event, the City of Boulder inspection is the "final" piece necessary for local licensing, which is a pre-requisite to state licensing. The inspection will occur at your business (both MMC and OPC) and will be attended by the COB building inspector, electrical inspector, the head of COB code enforcement, Mr. Dale Goetz, a City of Boulder police officer, the fire marshall, and Ms. Mishawn Cook the head of COB MMJ business licensing. Each person has a specific area of concern based on their specialty. Ms. Cook will be discussing COB ordinance compliance. A copy of the City of Boulder Medical Marijuana Inspection Checklist is attached. Please read it carefully so that you can get your affairs in order before the inspection.

Once each representative completes their inspection, a checklist of various items that need to be addressed will be created, packaged by Mr. Goetz and emailed to the business representative. According to Ms. Cook, you have to complete each and every item by 6/30/11. Ms. Cook advised that, if you do not complete each item to the City's satisfaction, your license will be denied. Ms. Cook is quite clear and resolute on this point. I do not know what will happen if you are denied based on outstanding issues that are beyond your control (i.e. permits, construction issues, timing of the inspection, etc.). According to Ms. Cook, the businesses have had alot of time to get into compliance with the City of Boulder ordinance and that the items addressed should come as no surprise.

Next, the State is also inspecting the businesses and you will be contacted by MMED to schedule the inspection. This inspection will have one or two MMED inspectors who are ensuring compliance with the rules and regulations that have been published and go into effect on 7/1/11. Like the City of Boulder, the state inspectors will create a list of items that need to be corrected. It is not clear how much time you will be afforded to correct the listed items. I suggest you review the rules and regulations to ensure compliance ahead of the inspection.

While having counsel present may not affect the outcome, it may help add credibility to the process, address any legal issues immediately and will help keep the inspections on track with relevant matters.
