Effects of the bill
According to the State of California analysis, the bill will have the following effects.[3]
[edit] Legalization of personal marijuana-related activities

  • Persons over the age of 21 may possess up to one ounce of marijuana for personal consumption.
  • May use marijuana in a non-public place such as a residence or a public establishment licensed for on site marijuana consumption.
  • May grow marijuana at a private residence in a space of up to 25 square feet for personal use.
[edit] Local government regulation of commercial production and sale

  • Local government may authorize businesses to sell up to 1 ounce of marijuana and to regulate the hours and location of the business.
  • Allows for the transportation of marijuana from one dispensary in one area to another without regard to local laws of intermediate localities to the contrary.
[edit] Imposition and collection of taxes and fees

  • Allows the collection of taxes specifically to allow local governments to raise revenue or to offset any costs associated with marijuana regulation.
[edit] Authorization of criminal and civil penalties

  • Maintains existing laws against selling drugs to a minor and driving under the influence.
  • Maintains an employers right to address on-the-job consumption of marijuana that affects an employee's job performance.
  • Maintain existing laws against interstate or international transportation of marijuana.
  • Any person who is licensed, permitted or authorized to sell marijuana, who knowingly sells or gives away marijuana to someone under the age of 21 results in them being banned from owning, operating, or being employed by a licensed marijuana establishment for one year.
  • Any person who is licensed, permitted or authorized to sell marijuana, who knowingly sells or gives away marijuana to someone older the age of 18 but younger than 21, shall be imprisoned in county jail for up to six months and fined up to $1,000 per offense.
  • Any person who is licensed, permitted or authorized to sell marijuana, who knowingly sells or gives away marijuana to someone age 14 to 17, shall be imprisoned in state prison for a period of three, four, or five years.
  • Any person who is licensed, permitted or authorized to sell marijuana, who knowingly sells or gives away marijuana to someone under the age of 14, shall be imprisoned in state prison for a period of three, five, or seven years

Why vote 'yes'??? It's already legal to possess a pound with a doctors approval...voting yes lowers the possession amount and reduces your growing area from 64 square feet to 25..it also brings government and big corporations into the fold, thus limiting our control...a very bad idea in my eyes.

the MMJ laws stay intact, it doesn't affect those limits
government is already in the fold, and it's a wolf, this would pull a few of its teeth

+1 on this, it shouldn't be a requirement to have a medical marijuana card in my opinion. It's just a shame my state doesn't allow for medical marijuana though.

It's not hard to get a card--AT ALL

Luckily MJ cures many ailments, therefore making a card easy
Obtain....from the outside it looks good (bill), bu if you livedhere and realized wuts going on, I think you might think differently.

I say vote no on legalize--I say decriminalize. I am legal with a note from my DR. I am not interested in paying a further tax on my property I pay over 8 k a year now for my land tax and get about 45 bucks of veggies off it a month. Now they are suggesting to tax me for land I pay tax on? Fuck them and their taxes and fuck those who lay down and take it!
You are crazy to fold for taxes, You keep doing this and pretty soon you are going to give your grand kids --kids a free ticket to being an indentured servants.
We out number them----do not them trick you with an award of something that is rightfully yours as your Great Grandparents did not put up with this. What I mean by that is allowing a child to play only if he or she works is basically robbing that child of it's child hood. When are you allowed to be play if not as a child?
Allowing something to be as long as you pay a tax is extortion! Like Alcohol for instance a widely used drug for "what ales you" however I can make it free in my home and if I am to lazy to do it myself I then can go buy it at the store with all the taxes and recycling fees included. Without Mr Brewer or Mrs Distiller or Mr & Mrs Vintner having to pay a tax on their home brew. So I say no go back and re- ink the proposal for decriminalization and not taxing an overly taxed society! I am sure any Gov't in the world will treat me like a King as long as I pay them...Right?
So am I part of this country or am I just a paying visitor? Because my family died in the Wars too.

Apparently getting a recommendation is too complicated for most Californians. They'd rather pay 10x as much in taxes to be served with golden spoon and platter.

I'd rather see NC 1380 myself. I kind of doubt it will pass this time around but 100sqft canopies and 24oz limits with clear understandable definitions has my interest. Not to mention they already have it in a minor drug schedule.

What is up with the ONE ounce limit?? does that mean you cant have more than an ounce at your home?? We can have 8 ounces now why would i vote yes for a law that would restrick me more??

the 1 oz is the 'carrying around' limit
you can basically fill your 5 foot x 5 foot space with whatever you can grow/dry/cure

3lbs for 100sqft. Or .75lb / 12 mos. Just over an ounce a month.

this will be true by state law, seems to be the consensus opinion, but then, i am not a lawyer
but on the DEA side of things, all MMJ is illegal, all recreational MJ is illegal, nothing changes on the federal side
in practice, your closet grow will be safer because it get the state out of the MJ busing business, as long as you keep it within the limits

Nowhere in the law does it mention any higher amounts that seems to just be peoples assumption. This isn't supposed to effect the mmj card holders however so they'll still have higher limits.

I'm more against the taxation. MMJ is steamrolling the nation right now. California is going to screw themselves if this gets rescheduled federally anytime soon. Just compare the wording in north carolinas 1380 bill and that of prop 19 or the current mmj reform here and you see a major difference. NC has some big potential to swing this nation IF they can get the ball rolling.

sadly, if there is a federal rescheduling of MJ, count on taxation
that is the deal illegal, or pay some taxes
the home grower will probably be the big beneficiary, taxing a home grow is likely not worth the trouble, commercial ops would be where the money is at
a lot seem to hate the idea of taxation, but if you don't like it, just stay with the old black market setup
