cultivation charges

Ok, where I live 5 plants= felony, 4 plants misdemeanor. My question is if 4 plants are close to harvest can you be charged for growing then charged for possession for the bud on the plant. 8 oz or less is misdemeanor. Just curious.

Thats not what i mean. If i were to cross the felony line, I'd step way over it. go big or go home. I'm sticking to 4. I just wanted to know if those 4 plants are mature, does buds on the plant = possession.

Knowing the way cops operate I'm sure they'll weigh all the plants, whole plant roots and all, and use that overexagerated weight for the possession charge (and then say it has a "street value" of 1.5 million)

Edit: they like felony busts, and if the cultivation charge isn't, then I'm sure they'll come up with a possession charge that is. Just keep lawyer money well hidden and make sure you don't venture into "non-probational" numbers.

you live in KY? I do. I usually keep 4 going, never 5. The answer, by the strict letter of the law is not you shouldn't get dinged for having just four HOWEVER - this will depend on the mood of said arresting officer. The case could be made to go ahead and weigh the plants wet with the soil - I've heard horror stories of this happening to folks where they say they had $10,000 worth of pot when it was probably more like $500-700. At any rate I'd say as long as you keep things on the down low you should be cool. I've been growing in KY for a long long time. Keep scales and extra baggies away from the grow area as this could lead to trafficking charges.

good god yes. Pills, Meth, and Heroin are plaguing this state. I would hope that Johnny Law has better things to do than jack over the home hobby grower that in my case has a real job, family and pays his taxes. I grow b/c I don't want to deal w/ dealers. Again, I think you should be fine as long as you keep it on the DL. Also use LED or a lot of floros, HID is very hard to hide indoors and can also burn your GD house down. Cheers!

Ive done outside guerrilla grows outside for years. The type of places where you can hike all day and never touch a rd. I Just started indoors. Ole lady has my camera, I'll take some pics later. Got over 300 actual watts of cfl on 4 girls.

that's how I started. I used to use about 400 w of CFL on 4. Now have stealth wall in spare basement room w/ about 1000w of LED. Just pulled some purple x-mas trees for myself and family/friends. I don't post pics anymore, promised my wife I wouldn't. The journal in my sig documents most of the evolution of my grow room.

I'm pretty sure as long as its in soil you can only be charged with culvitvation, if its hanging they are gonna get you with possession of the weight, although I have heard stories of people getting popped and getting charged with the plant roots with a bigass dirt clog and some more, it all depends on who's in charge i suppose.

I'm not scared just curious. I'm not in it for profit, just personal use.

in the uk as long as the bud is still on the plant its cultivation, if its off the plant then its possession, makes sense to me, but in court they will try and say you are growing plants worth a couple grand each. im up for a few charges soon, only being done with misuse of drugs so far, but the case is still pending while they look into it. im sure i will get cultivation on top.

There should also be a weight added to the grow...

For instance, 4 plants up to 1 kilo = X charge.
4 plants over 1 kilo = XX charge.

You should be able to very easily do a google search and find exactly what your state law is.

I did some research before asking. It just states that less than five plants first offense is misdemeanor. Five or more Felony. It says nothing about size. I would assume that means 4 20 ft plants would be the same as 4 1 ft plants. You know what they say about assuming. I think thats where the horror stories of dirt and all being weighed for them to get felony possession. I also guess if they wanted to be dicks, according to definition, each single piece of equipment could be a separate paraphernalia charge.
