HB 1261 THC/DUI Bill Moves Forward

I went to and spoke at Yesterday's hearing and I can ssay that i was pleased with the turnout and all of the well thought out testimony against the bill. On the other side of the coin all of the stops were pulled.

The Quote of the Year comes from a concerned mother and her thoughts on how to determine if someone is high. "YOU CAN ALWAYS LOOK AT THEIR TONGUE, MOST OF THE TIME IT WILL BE GREEN"

Even with crazy lies like that being said the HB1261 moved out of the House Committee by a vote of 6-2. It will now be introduced to the House Floor here soon.

"The bill would allow prosecutors to charge a driver with driving under the influence if they test positive for 5 nanograms or more of THC, a level that would be the most liberal in statute in the country. Pennsylvania also has a 5 nanogram limit, it's one that set by the state Health Department that can be used as evidence in driving violation cases. THC is the psychoactive ingredient in marijuana"

Let's see DOR is making a database of all registered MJ patients and giving instant access to law enforcement

and now have a way coming to generate more state revenue via this new bill (all laws are about revenue)

the limit is pretty much garanteed to be present in most med patients via bloodtest

what a shame average cost of an alcohol DUI is 10 grand now we are gonna start seeing dying cancer patients on disability funding our states deficits

I am absolutely amazed and sickened by how literaly stupid our lawmakers are

Yeah im probably in the same boat, don't typically smoke till 10 in the mornings, but i bet even right now when i haven't smoked since midnight i am still way way way above that limit, and i am starting to shake a little. So if i was to lower my body's thc level to that point, i would be having withdraws. So honestly i am seriously considering letting my card lapse this year, i have to drive, i don't have to be on the registry, i have plenty enough issues for an affirmative defense for my grow, but there is no affirmative defense for a DUI.
Anyhow what are they worried about? Us driving too slow cause were high? I know thats all the more it does to me, otherwise im doing 10 over the speed limit.
 
When you take your first hit in the morning your Levels spike up to the 35ng range and they sat it takes 3 hours usually to go down to the 5ng level they want you to have before you drive so...

This is insane, if the levels in the BLOOD drop as fast as their link to NORML's info which they nitpick only the stuff useful to their case; even if you smoked, hopped in your car and got pulled over, it would take some time to get you to the station and have you submit a blood sample. I doubt officers on patrol are going to be carrying around syringes to test people on the spot. Is it going to be enforced like breathalysers?? I refuse to get injections or anything with needles, let alone have my blood drawn, so will I automatically be presumed guilty until proven innocent if i refuse to let them jab me?

Why so much discrimination against the sane people who use an herb and the people who choose to take a concoction of dangerous chemicals in pill form for their ailments are free to pass out at the wheel and cause accidents and not be held responsible because it was there "BIG PHARMA" medication that caused the blackout........... The commercials say " Please don't operate a vehicle until you know how *insert drug here* will effect you..". It's left to the users discretion. If I was so high "magical unknown strain that doesnt exist" that I couldn't walk, talk , see, impaired locomotion etc... I WOULDNT TRY TO DRIVE, its not alcohol, you don't feel like super man. Your sense of danger is not removed.... You would think " Damn thats some good shit, I cant even see strait. NO fricking way am I gonna try to drive, I think ill just make something to eat and veg on the couch till I come down."

Well I know how cannabis effects me , it makes me normal.

Why aren't there roadside tests for people on any kind of opioid?
The law states the following about Driving Under the Influence
There are LAWS for this but they are NOT enforced until there is an accident, then just that one individual who because of the accident gets tested for all drugs gets charged. Why not ACTIVELY go after these users???? Because BIG PHARM would be all over their asses.

"Driving under the influence" means driving a vehicle when a person has consumed alcohol or one or more drugs, or a combination of alcohol and one or more drugs, which alcohol alone, or one or more drugs alone, or alcohol combined with one or more drugs affects the person to a degree that the person is substantially incapable, either mentally or physically, or both mentally and physically, to exercise clear judgment, sufficient physical control, or due care in the safe operation of a vehicle."

They should give a motor skill test, or use a mental aptitude test. Why not do the same things they would do to someone you "assumed was drunk" before actually giving them the breathalyser? Determine whether or not we are actually substantially incapable, either mentally or physically, or both mentally and physically, to do what we have done every day for the majority of our lives, driving.

You really are spot on here, if your clearly drunk they still give you a field sobriety test, if you pass you don't even have to do a breathalyzer, giving that is based solely on the LEOs opinion. So if this passes and i get pulled over with my eyes bloodshot as the always are, do i get the benefit of a Field sobriety test? I hope so cause im gonna pass that shit regardless of how high i am.

Hey Colorado RIU brethren. It's been a long time ... This is enough to bring me back though ... WTF!! Every med patient on the registry is going to be over that limit. Besides, don't we already have laws against driving under the influence of 'drugs' anyway?

I wonder where one could go to be tested on their own to gain some insite as to what it actually takes to hit the 5 ng level?

From my research it looks like many patients would fail even after going hours, or even overnight without smoking, and you will still test positive well after all the effects are gone.

I wont be driving tho haha.. five nanograms?? All joking aside both of my parents were hippies, and id bet i had that much THC in my bloodsteam when i was born. Soooooo how will these road sides be conducted do you all think? this is where we make fun of ourselves.. they should include a munchie meter, some type of comedy, maybe a guitar a pencil and some empty sheet music paper. The only time i can not drive and im high is when im sleeping. btw wouldnt you all agree that driving while tired is much more dangerous than driving while lit?
