Laws on smoking in a leased/owned commercial spot

Are there any laws in CO that prohibit a typical shop owner from allowing people to bring in herb and smoke in said establishment, no buying or selling involved here. I read something about a gentlemen attempting this only to get shut down but it was before 64. Now that 64 has passed will there be restrictions on or necessary licenses for places that mimic Amsterdam coffee shops, for lack of a better word, minus the selling? Or would that choice be up to the simple discretion of the owner/landlord?

I believe all states, but i am positive that Colorado has a law stating that smoking inside of a business is illegal. So while this was intended for tobacco, you know we fall directly in the cross hairs....
Some Cigar shops have been able to get special exemptions as almost all of their profits are directly from tobacco, so there is some presidence on the matter, and with enough fighting and the right county you may be able to get away with it..... but expect a fight.

would this hold true if the business were private trueno?? for instance, i know in philly, you can't smoke in bars now, but they have cigar bars were you can indeed smoke inside, but i'd think they're a private place and not open for the public, hence how they probably get around that law.
not sure if one could do the same for a weed club like the op is talking about or not.

A club membership would be a loophole i think, but what businesses are private besides those? I really think you are on the right track though racer, i may look into what the cigar shops did to get the ok from the gov't.
Its the same here, no smoking in bars or restaurants, but you also can't smoke in your own office, even if you are the only one in there.

wtf?? that's crazy.. they're taking the no smoking thing a bit too far imo, but yah, i'm a smoker, lol.. even if i weren't, i think i'd feel the same though.
nj is really crazy.. my old work, they made it so we had to drive off of the property to smoke a cigarette at all, and now i'm gone from there, i see all sorts of people standing just off of company property so they can smoke.. it's the most retarded thing ever imo..

and i'm not sure if those cigar bar places are private establishments or not but it's the only way i can see how they're getting around the law honestly as private establishments can do a lot of things public places can not..

I am not a smoker, so i am a fan.
But 90% of the places you go there is someone standing right outside the door smoking a cig and all the smoke is blowing in everyones face as we walk in. I feel this has a lot to do with why smoking weed in public was specifically prohibited in Amendment 64, otherwise i would be doing the same shit (nah im more respectful than that).

have you ever been to amsterdam trueno?? i was there a few years ago, and the second i walked out of the central station, to pretty much the second i boarded my train back to germany, all i could smell was weed, weed every where..

now, i happen to love the smell of burning cannabis, did long before i even smoked it, but i will have to say that the smell was a bit much even for me.. it really is overwhelming over there to say the least..

Colorado has laws against smoking inside a public building. This includes tobacco. If the public is allowed in the building , NO SMOKING !

also , after ammendment 64 , you have to smoke your Herb on private property. Not allowed out in the open .

64 will probably have to have its own requirements and I image correct zoning and permits will be required.

Of course there are exceptions to every rule. Smoking will be permitted in the following locations:

* Private homes, residences and automobiles unless they are being used for child day care or day care

* Limousines under private hire

* Up to 25 percent of rented hotel or motel rooms

* Retail tobacco businesses

* An establishment that met the definition of a “cigar-tobacco bar” as of December 31, 2005. A "cigar-tobacco bar" is defined as an establishment primarily for the sale and service of alcohol beverages for on-premises consumption where the service of food is secondary to the consumption of such beverages that generated at least 5% or more of its total annual gross income or $50,000 in annual sales from the on-site sale of tobacco products and the rental of on-site humidors. Note, this does not include any sales from vending machines.

* The outdoor area of any business as long as it is beyond the 15 foot radius around the main entryway

* The retail floor plan of casinos

* The airport smoking lounges at Denver International Airport

* Employers with three or fewer employees/volunteers who do not allow access to the public

* A private, non-residential building on a farm or ranch that has an annual gross income of less than $500,000

Nope never been to Amsterdam, or ever heard that before. Makes me wonder what will happen around here when things get in full swing.....

oddly enough, there's a head shop near my house, they smoke cigs inside all the time, any customer can. Even with cops in the store. I was always confused because there's some hookah bars around here that still get fines for indoor smoking

I've been to Amsterdam too many times to count (not that I could remember anyway) and what you wrote is only true in the red light district, which happens to be a couple of blocks away from Centraal Station. Most American stoners stay in hotels and hostels located in the red light district and hardly ever venture out of the red light district while they're in Amsterdam. Not saying that's what you did, but it happens to the best of us on our first to Amsterdam. Myself included. Once you make it out of Centrum, the city becomes more normal and the coffee shops are more few and far between. That said, Centrum has absolutely beautiful architecture. There's a reason why Amsterdam is called the Venice of the North. One of my favorite things to do in the city is find a coffee shop on a nice canal, smoke a big fat spleef on the patio, and watch the world go by.

I've only been to Amsterdam once. Spent 4 days in Leidseplein and explored the city from there. Great city, legal smoking is just a side benefit in my opinion. I will say the fresh Thai mushrooms I had there were very good though...

Leidseplein is a great area to stay in Amsterdam especially if you're young and like to go to awesome clubs that are open all night long. Travel tip: You won't get into most of those clubs if you're not wearing dress shoes or if you don't have plenty of girls in your group. The bouncers are paid to prevent their clubs from turning into sausage fests. One of my favorite coffee shops in that area is De Dampkring on Handboogstraat. That's where I first tried White Russian during the 1996 Cannabis Cup. Coincidentally, I'm growing Serious Seed's White Russian for the first time right now. Small plants with big fat colas, but the trim doesn't look like it's going to be that great for concentrate extraction....
