1.17.2 Incidental amount of marijuana. Incidental amount of marijuana per patient means up to 12 female nonflowering marijuana plants; an unlimited amount of marijuana seedlings, seeds, stalks and roots; and up to eight ( 8 ) pounds of harvested dried unprepared marijuana in varying stages of processing that are not included when calculating the “allowable useable amount of marijuana.” See 22 M.R.S.A. §2422 (4-A).


1.17.5 Seedling. Seedling means a marijuana plant that has no flowers (buds), is less than 12 inches in height and diameter. A plant that does not meet all three criteria will not be considered a seedling.

Whats up with outdoor cultivation this year, any news on that? Is only greenhouse growing(enclosed outdoor facility) permitted?
 
Question on the '8 lbs' though - it says 'unprepared' - by definition I would assume this to mean 'not ready for consumption'. But isn't that a very gray area?? I mean, if you've got it all in curing stage - who is to say when it is ready or not, therefore 'prepared'?

What I find really odd is that these rules have yet to be posted on DHS's MMJ page.

I too was taken aback by the 8 lb limit, but I believe it is accurate. I agree that it is still a little ambiguous as to what is prepared (dry) and unprepared (dry) marijuana. Most people take it to refer to the curing process, and the safest way to approach that is with dated labels on your jars I guess.

My problem is this: I don't know which plants are male or female yet. Do they still qualify as seedlings if sex has not been shown yet.
They are all over 12 inches tall but i have no idea on their sex yet. Are these going to put me into a non compliant situation?

Any help you can give is greatly appreciated.

You raise an interesting question. However, one would have to be quite expert to tell whether a plant is male before it buds at all, and even then it wouldn't be certain imo. On the other hand, why worry? The law defines a marijuana plant as, among other things, female right? So why would a male plant even count toward your limit? In the context of this law, it isn't even a marijuana plant.

I'd be more worried about culling males out of my grow than leo to be honest.

I guess what i was wondering about is:
If the police came and saw my plants would they be like, "oh look how many plants over 12 inches he has- lets get him."
or-would they say "Hmmn, none of these are flowering so i guess they are seedlings."

I know that 1/2 of the seedlings a person starts are male. I know the plants that came from feminized seeds and i am assuming they are female.
I guess i want to just check the waters to see if i will get into alot of trouble while trying to set my grow up.
I'm still trying to find my grand slam plants and many are up to 36 inches but haven't sexed yet.
I read the law but must confess, I was a lineman for 25 years and the letter of the law is not my forte. My understanding of things is limited.
I thank you for any help anyone can shed for me on this subject. When i first read the 2013 updates i actually understood them backwards.
I thought it said they were seedlings if they were not (flowering,12 inches tall and 12 inches wide)When it actually is saying (It's not a seedling if any of the 3 exist).
Maybe I'm still confused.

A seedling a plant that is < 12" tall OR < 12" wide OR < 12" both ways. A vegging plant is > 12" tall AND > 12" wide. Technically male plants do not count at all, but i'm not sure how you would argue that to LEO if they came asking about it.

With training you should be able to determine the gender of the plant from pre-flowers long before they exceed the 12x12 limit. I top plants at about the sixth node and generally see pre-flowers when they are about 8-10" tall.

Almost all males will auto flower if you keep them in veg too long. They will show. Males are a bitch if you want to keep them around.


For caregivers:

5.8.1.1.2.1 Legible Tag on each mature plant. A primary caregiver must have a legible tag on each mature marijuana plant. The tag must include at least the patient's last name.

lol....who's gonna do that....that had to be directed to dispensaries....

I was not aware of this clause, but if that's what it says that's what I am going to do. No big deal since I am 100% legal anyway. Just add it to the strain name label. Only gotta label the flowering ones.

They have it too. I will try to do it, but my writing isn't legible.

Almost all males will auto flower if you keep them in veg too long. They will show.
Most cannabis strains will develop visible flowers (male and female plants both) from the stress of wanting to flower, but i've haven't seen a male go into full blown flower mode without cutting the light back. I've kept males around for a year or so in the veg room without any problems.
