Taxing a controlled substance/ Double jeopardy?

Can someone make some sense of of this for me or does it actually say what I think it does?

If I'm reading correctly marijuana is taxed and failure to pay the tax can result in payment of back tax, up to 5 years in prison and a fine of $10,000. So, does that mean that even someone caught with under an ounce can, even though it is only a fined offense, then be charged and potentially imprisoned for tax evasion? I'm not involved in any pro or cons about Mass and marijuana but marijuana was decriminalized over major law enforcement protests in 2008 and this was enacted in 2010 this just seemed to be some sort of end around for law enforcement.
 
The government hates nothing more than not getting their cut on a substance they have banned. I think it's just a way to tack a heavy fine on bulk arrests.
