The following information is intended as a brief summation of your constitutional rights and is meant to offer helpful hints at how to effectively assert and protect those rights within the context of a police encounter. Of course, this information is no substitute for consultation with an experienced attorney.

The Fourth Amendment to the Bill of Rights of the United States Constitution states:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
The Fifth Amendment reads, in part, "No person shall be... compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law...." These amendments provide the foundation for the rights that protect all U.S. Citizens from intrusive law enforcement practices. If an officer violates your rights then any evidence discovered as a result of that violation must be suppressed from the evidence at trial. This is accomplished by filing a motion to suppress with the trial judge. Even if an officer obtained a warrant prior to searching, if that warrant is defective or not supported by probable cause, then the evidence must be suppressed. Often times, after the fruits of an illegal detention, interrogation or search are suppressed, the government is left with very little evidence and the charges are dismissed.
1. Don't Leave Contraband in Plain View
Although law enforcement officers must obtain a warrant before they can conduct a privacy-invading search, any illicit material that can be plainly seen by any person from a non-intrusive vantage point is subject to confiscation. An arrest and a valid warrant to search the rest of the area is likely to ensue. A "roach" in the ashtray, a pipe or baggie on the coffee table, or a joint being smoked in public are common mistakes which all too-frequently lead to arrests.
2. Never Consent
Many individuals arrested on marijuana charges could have avoided that arrest by exercising their Fourth Amendment rights. If a law enforcement officer asks for your permission to search, it is usually because: (1) there is not enough evidence to obtain a search warrant; or (2) the officer does not feel like going through the hassle of obtaining a warrant. Law enforcement officers are trained to intimidate people into consenting to searches. If you do consent, you waive your constitutional protection and the officers may search and seize items without further authorization. If officers find contraband, they will arrest you.
If you do not consent to a search, the officer must either release you or detain you and attempt to get a warrant. The fact that you refuse to consent does not give the officer grounds to obtain a warrant or further detain you.
An officer can obtain a search warrant only from a judge or magistrate and only upon a showing of "probable cause." Probable cause requires an officer to articulate information that would cause a reasonable person to believe that a crime has been or is being committed and that evidence of that involvement can be found within the object of the search.
There are exceptions to the search warrant requirement which permit an officer to search an area without a warrant or consent under certain circumstances. The important thing for you to remember is never to consent to a search or talk with an officer if you want to preserve your rights.
If an officer asks to search you or an area belonging to you or over which you are authorized to control, you should respond:
"I do not consent to a search of my [person, baggage, purse, luggage, vehicle, house, blood, etc.] I do not consent to this contact and do not want to answer any questions. If I am not under arrest, I would like to go now (or be left alone)."
3. Don't Answer Questions Without Your Attorney Present
Whether arrested or not, you should always exercise the right to remain silent. Anything you say to law enforcement officers, reporters, cell mates, or even your friends can be used as evidence against you. You have the right to have an attorney present during questioning. Your right to remain silent should always be exercised.
4. Determining if You Can Leave
You may terminate an encounter with officers unless you are being detained under police custody or have been arrested. If you cannot tell whether you may leave, you can ask officers, "Am I under arrest or otherwise detained?" If the answer is, "No," you may leave.
An officer can temporarily detain you without arresting you if he has "reasonable suspicion" that you are involved in criminal activity. An officer must be able at a later time to articulate to a judge objective facts that would have caused a reasonable person to suspect that you were involved in criminal activity at the point that you were detained. Also, the officer may perform a "pat down" or "frisk" on you during the detention if he has reasonable suspicion that you are armed. However, an officer may only reach into your pockets if he pats something that feels like a weapon.
When an officer attempts to contact or question you, you should politely say:
"I do not consent to this contact and I do not want to answer any questions. If I am not under arrest I would like to go now (or be left alone)."
If arrested, you should again refuse a search of any kind and refuse to answer any questions. At this point you should insist on speaking to an attorney as soon as possible.
5. Do Not Be Hostile; Do Not Physically Resist
There are times when individuals politely assert their rights and refuse to consent to a search but the officers nonetheless proceed to detain, search, or arrest them. In such cases, it is important not to physically resist. Rather, you should reassert your rights as outlined above in section 2.
6. Informing on Others
The police and prosecutors often try to pressure individuals into providing information that would lead to the arrest and conviction of others. Threats and promises by police and prosecutors should be viewed with caution and skepticism. Decisions should only be made after consulting with an experienced criminal defense attorney and examining one's own conscience. Finally, consider downloading and carrying NORML's Freedom Card -- a quick reference guide to your rights and obligations when you are stopped by the police. The Freedom Card

The U.S. Constitution prohibits the government from interfering with
your right to remain silent, to consult with an attorney, and to be free
from unreasonable searches and seizures by law enforcement.
However, it is up to you to assert these rights. This NORML Foundation
Freedom Card will help you do so effectively.
If you are confronted by a police officer, remain calm. Be courteous
and provide your identification. Politely refuse to answer any further
questions. Ask to talk to an attorney. Do not consent to any search of
your person, your property, your residence or your vehicle. Tell the
officer you would like to give him or her this card, which is a statement
of the constitutional rights you wish to invoke. Do not reach for this
card until you have obtained the officer’s permission to do so.

I hereby invoke and refuse to waive all of the following rights and
privileges afforded to me by the U.S. Constitution:
• I invoke and refuse to waive my Fifth Amendment right to
remain silent. Do not ask me any questions.
• I invoke and refuse to waive my Sixth Amendment right to an
attorney of my choice. Do not ask me any questions without my
attorney present.
• I invoke and refuse to waive all privileges and rights pursuant

to the case
Miranda v. Arizona. Do not ask me any questions or make
any comment to me about this decision.
• I invoke and refuse to waive my Fourth Amendment right to be
free from unreasonable searches and seizures. I do not consent to
any search or seizure of myself, my home, or of any property in my
possession. Do not ask me about my ownership interest in any
property. I do not consent to this contact with you. If I am not
presently under arrest or under investigatory detention, please allow
me to leave.
• Any statement I make, or alleged consent I give, in response
to your questions is hereby made under protest and under duress and
in submission to your claim of lawful authority to force me to provide
you with information.

I'm wondering, has any grower or user ever contacted an attorney and put them on retainer in case there is ever a problem? I'm thinking of contacting a local NORML lawyer and doing so. I don't want to be in the situation at 2 AM and be in a panic as to what to do if the worst should happen. Anyone think this is a good or bad idea? What would an appropriate retainer be? $1,000.00?
I have access to lawyers I've dealt with for one reason or another, but think it might be wise to talk to one of the NORML listed lawyers befoe something happens rather than after.

hahahaha every grower should know that... Ill add to that... If you are a new grower stay away from miracle grow and all other chemical nutes... Organic nutes are the only way to go...

HOPES SOMETHING IN THIS HELPS

cherry popping grow technic (get a few grows under your built before jumping into advanced cultivation, learn the basic)bongsmilie

a good location, soil, nutes, lights, and co2 can only take you so far
big buds and good yeilds are based on genes and growing skills

plant life is tipicaly
2wks-1month veg 24/0 or 18/6
2-3 month flower 12/12
4 months (maybe 3) all together from seed to cured smoke

everything can be found at any bigbox store

place seed in a cup of water
check every day untill you see seed crack and or tap root
then place in a 1in deep hole covered with soil, in a 1 gal pot full of soil
now get a digital thermometer, one with a temperature and a humidity gauge
optional items : heater, a/c, dehumidifier
maintain lights on temps of 70-80 (with co2 you can let it go as high as 95)
at lights off stay above 60. keep humidity around 40%-60% light on/off
when you see a sprout
place light (26 or 42 watt CFL with hood and clamp) over it keeping light as close as 2-4 in. as the plant gets bigger add more light (if you use mh or hps follow light distance guidelines, you'll find out more about them as you advance in you grow skill)
now time for veg growth
get a light with hood (and put it on an on/off timer set timer for 18/6
water plants ever 2-3 days or when soil is dry
after 2 weeks of just plain water introduce nutes at 1/4 strength, every other water
inrich air with co2 if you gat it (not needed if less then 6 plants, just open a window or pump in fresh air)
after 2wks too a months of vegging its time to sex and flower
tranpants to a 3-5gal pot
if still useing CFL's double or triple the amount of lights (the more light the more dence and bigger the buds will be)
set timer for 12/12 (depending on strain plants can double even triple in size (height) in this stage)
this will show sex and flower your plants, giving you smokable buds
keep the female's they grow white hairs
discard the males they grow grape like ball clusters (pollen sacs)
discard the hermi they grow both sex (re. if it has balls on it discard it)
give it 2 wks of 12/12 then increase nutes
lights will stay on 12/12 untill finish which could be 8-14 wks depending on strain dominates :
short plant with fat wide leaf = indacas = 8-10 wks,
tall plant with long skiny leaf = sativas = 10-14 wks
by far the best way to tell when the plant is ready to harvest is by looking at the trichome
you want to harvest at about a 40%-50% red to white ratio. you will need a minimum 30x zoom microscope (radio shack)
flush plant by feeding plain water no nutes for last 2 wks (improves taste)
cut, hang, dry 5-7 days @ 40%-50% humidity
smoke
or
cure:
place in mason jars sealed tight for 12hr
open jar and take buds out and let dry for 30m - 1hr or untill dry
replace in jars reseal
repeat this for 2wks to a month or untill buds nolonger become wet in jar after 12hr
now smoke
or
seal away for longterm storage

rules to a successful longterm grow
1. tell NOone
2. NEVER ever break rule 1
3. dont grow where you dont own
4. restrict weapons of any kind on property
5. be seen, but keep a low profile in community
6. suppress or eliminate odors emanating from grow room
7. pay your bills
8. descretly acquire & place items
9. descretly despose of waste
10. don't talk to the police. if caught tell them your name and ask for your lawyer. say nothing, sign nothing. sign nothing that says you said nothing. ask for your lawyer
