WASHINGTON — The Supreme Court ruled unanimously Monday that police must get a search warrant before using GPS technology to track criminal suspects.
The GPS device helped authorities link Washington, D.C., nightclub owner Antoine Jones to a suburban house used to stash money and drugs. He was sentenced to life in prison before the appeals court overturned the conviction.




Associate Justice Antonin Scalia said that the government’s installation of a GPS device, and its use to monitor the vehicle’s movements, constitutes a search, meaning that a warrant is required.

<edit> That doesn't mean for a hot second that savvy enforcement pros won't be using it right and left. They'll use it "off book" in order to make building an official, court-admissible evidence trail on anyone who gains and holds their interest. This is a victory in the courts, but for those of us who remain afoul of federal law (and there are <cough!> some) it's still a warning to remain attentive to personal security.

lol, No, No, No we didn't use GPS, what we did was we took this Carrier Pigeon...

it makes me feel better about my electronics but still i might not carry a cell phone for a while still. so fucken amazing.i keep everything under the radar for fear but now this makes it harder to get me.so i never have to worry about gps shit! YAYA!

Pork liver? With goose fat? I don't know...

I think that it is a start. I don't think we can call it a legal win. But will the police follow the court ruling? Only time will tell.

Edit: what did i say? not a legal win. IT IS A HUGE LEGAL WIN. But, will the police find a way around it.

nothing lucky about it. the constitution is clear. if the dude didn't slip up bad enough to get a judge to sign off on a warrant for the gps then he can't be convicted. i'm just glad the supreme court finally chimed in. i just read this about 20 minutes ago and i was fucking thrilled beyond imagination.

i have absolutely zero issues with criminals being allowed to walk free if it means protecting civil liberties for everyone else. cops only care about arrest and conviction rates. who gives a shit if all the "bad guys" are in jail if just anyone can be villified by the police without procedure? it makes convictions meaningless.

i am so fucking happy about it i can't even describe it.

reading the article i get the impression that the court would like to address other technologies that amount to illegal searches, which thrills me even more.
