The United States Supreme Court has made clear on a number of occasions that you are “seized” when a reasonable person would not feel free to leave. In this case, even though the stop is supposed to be over, the police officer still has your identification, which you are not going to leave without. On top of that, he has asked you to come with him to his car and indicated that you will not get your identification back until you answer some questions. So, you would not feel free to leave and thus you are still seized. However, because the purpose of the stop (the jaywalking ticket) has been completed, you are no longer “stopped.” When you are “seized” but not “stopped,” legally speaking there is only one other option – arrest.
Most people, even police officers, do not understand the point this example makes. Many folks (including some police officers) think a person is “arrested” when the officer puts the cuffs on them and says what TV cops say, “You’re under arrest for the crime of something or other. You have the right to remain silent, etc.” In fact, the lines between being involved in a consensual questioning session, being stopped, and being arrested are much blurrier and harder to figure out than TV makes them seem. In this example, because the officer has specifically conditioned the return of your identification on you answering questions about the recent assault and, in addition, has ordered you to come with him, there’s really no doubt that he is intending to detain you beyond the scope of the jaywalking stop. Thus the most reasonable conclusion at this point is that you have been arrested on suspicion of assault.

I think all cops need to wear body cameras, so this off camera shit doesn't go on. I've been "tuned" up by cops. Your word don't mean shit against theirs A camera will stop a lot of this

Using Sandra Bland's standard, that cat should have been shot on the spot. But guess what? He got to go home to his family. What do you think the cops would do to me if I tried to pull that shit in the video above? Serious question.

Honest answer: idk wtf to even think of that video because that dude is like off his rocker. He is lucky the cop didnt make him do a sobriety test or some shit to make sure he wasnt under the influence.
I would expect us to be treated the same in either situation regardless of our skin color (assuming you are a black male from your reply) but obviously it is naive for me to assume 100/100 times that will be the case. Because the unfortunate reality is there are racist assholes out there, some of whom have a badge. But it isnt a job requirement for cops to be racists or assholes because I have met my share of reasonable cops and also had the assholes.

Here is the flip side to your question, if sandra bland wasnt black but instead a white woman what would your reaction to this be. I know you could say the stop wouldnt have happened in the first place because she is white and wouldnt have been stopped for a failure to signal. But just humor me and think if she was white and acts the way she does is she till in a jail cell to hang herself (regardless of whether the stop was legal or not I am not convinced she was murdered) or is she on her way. My take, she is still there because I have seen first hand a women give a cop hella attitude, she started pointing her finger an inch from his face and he took her skinny ass by the wrist and put her to the ground in a second. Was it right, not in the strictest sense of the law but there were plenty of bystanders and no one was crying police brutality. A few clapped, because man or woman, black or white there is a proper way to conduct yourself.

And I would say that the cop broke that conduct as well as bland but has being an asshole to an asshole every gotten anything done for you?

P.s. the cop in bucks vid gets hella condescending when he starts explaining the ticket, so had that situation gone south you could try to make an argument that he escalated it as well with his demeanor but scemantics and all...

Feel I should clarify the chick that got taken down by the cop in my post was drunk at a stock car race. So to say she was white trash is an understatement lol, if she was a rich white lady I am sure this scenario would have olayed out differently. But thats my take on most things, its a class war not a race war people. They use the racial issues to keep us distracted from the issues of inequality at a larger scale.

Being an Asshole to an Asshole has made me feel better expecially when I am trying to excalate it to the point of them provoking me to kick their ass. Something I don't do with cops that have a gun and a badge.

Although I have told them to get the fuck off my porch. But I have the Luxury of a camera system with audio on my porch with 2 angles

I got pulled over for "driving while white" My job at one time was in a crime ridden predominatly black neighborhood on 3rd shift.
I got pulled over by the tactical squad one time. I was asked to step out of the car. I wanted to close my door. The woman cop was holding it open, I brushed her arm away trying to close the door and was promptly arrested for assaulting a police officer. 20 minutes later after searching my car and calling my employer. They took the cuffs off, and let me go to work.
no apologies. Just an explanation that I was in a bad neighborhood

I won't tell you that the stop wouldn't have happened, but I will tell you with 100% certainty that the white woman wouldn't have been arrested and found dead in her cell 3 fucking days later. You keep trying to blame the victim here. These are the white male eyes you're looking through again. Those eyes see the police as protectors. If you just cooperate, everything will be alright. Through black eyes, that is complete bullshit. We see the police as a fucking gang, (terrorists even) just like the bloods and the crips. the only difference is the fact they have the state backing up their terrorist activities. Should I have to FEAR being stopped by the police? Because I do, and I'm not a criminal.

Oh it is certainly vindicating because I cant say I dont act like an asshole to assholes. But like you just said you dont engage a cop in a asshole pissing contest because they just about always win. You can just hope to make them look stupid by knowing your rights

Perfect example: I was 17 years old walking around the small town I lived in at the time. I walked past the school, no particular reason I just did. I am about 5 houses away from my house and a cop pulls up and gets out of his car and asks if he can talk to me quick. I have a 20 sack in my pocket so I am not inclined to want to engage him but I respind to him being polite but short at fhe same time. Asks me why I went past the school, tell him no real reason. He says thats odd to which I shrug amd he asks my name, this is when I inform him I am under 18 and I would like a parent present if the questioning is going to continue at which point he put away his pen and paper and got in his car and left. No good night or nothing lol. Was I an asshole not really but he mean mugged the fuck out of me every time he saw me but he never got me because I didnt give him anything to go on

He provoked the traffic citation by tail gating her. I see this move all the time by cops

i do not think she was rude, she was just moaning

but as things escalated, her tone changed and she started speaking more like a gangsta
this upset the cop even more
and then she got out of the car and was taller than him lol
fuck she might as well of spat in his face, cops have such low self esteem takes very little to make them feel small

i agree with the class thing, the cop most likely thought someone from the lower classes that talks like she did
should be, "yes sir, no sir" and when she was not like that, it hurt his cop feelings and self esteem
so he decided to show her who's boss

do you think you guys will have some riots over this ?

Pretty sure that it would have taken them longer than 20 minutes to let me go. That's if they didn't beat the hell out of me for "assaulting" a police officer.

but he asked her,. he did not give her a direct instruction/order, so she was free to decline his offer

Ultimately you're right. It is a class war. But let me tell you a little bit about "class". Classes are a lot easier to distinguish when they have a different color of skin. Poor whites have it pretty bad as well, but please don't confuse the plight of poor whites to that of which black folks must endure in this country. It's not even close to the same thing. Poor whites are the ones who catch hell when there are no blacks around.
