You can press charges against them for trespassing and theft. They need your permission or have to present a legit warrant to your face by a Marshall or Sherriff to even enter your property.

A warrant will have case number, judges signature, a state seal, the penal code of the law broken and a description of why they got the warrant.

What they did is illegal.
They hit my buddies spot, he stood his ground. Defended his land and called his lawyer instantly. They didnt take any of his shit but ticketed him with over 4 grand in bullshit fines.

I'm about to walk in have the meeting with this lawyer . I'll throw whatever money I need to into making these fucking ass holes pay . I'm fortunate enough to be able to do this and if everyone who can sue should sue . We can't let these pigs think that the dumb pot heads of the world are going to back down . I'll probably lose but next time they see my name maybe they will think twice before fucking with me
Hate to say it but I think youre just throwing money down the drain. You've got it backwards. When they see your name again they are going to bring the hammer...

Sherrifs and judges tend to be politicians too, at some point the people can't be ignored. But yeah if you fight know that it's for the long haul if you stay in the area. Good luck man, hope that lawyer knows their shit.

One of my best friends who lives and grows in the same county just finished his criminal justice degree, and his dad is a sheriff. He says it only takes 15 mins to get a warrent to rip plants and I believe him. Unless you have any evidence besides your opinion I'm going to listen to the expert.
Not my opinion it's a fact. I would love to see a warrant written out, dated, stamped, signed, processed, then handed to the police, who then plan the search warrant out, suits up and then needs to wait for the correct time to execute that search warrant....(generally in the middle of the night like the cowards they are) in 15 minutes. It would never happen. It couldn't happen as it would take the swat team longer to get dressed/suited up. Im not trying to continue to argue but you arent getting a warrant signed, and served in 15 minutes. Even a telephonic warrant would take hours and that is a emergency use not for 18 plants....

EDIT: Good luck OP hope everything works out your way. Hopefully the lawyer finds out they did something wrong, or filed the wrong paper work, crafty people they are haha

As long as it takes to make a phone call, slap a few stats on a pre-approved warrant and for a cop to drive across town is how long it takes to get the warrant.

What is a "pre-approved warrant" to get a warrant you must first have ample evidence against the person and if you unlawfully got the information the lawyer can help.

My lawyer informed me that for code violation they can't get a warrant to search my house . Also I was suppose to have time To get my stuff up to code . Instead she gave me altimatium right than to chop it down . Lawyer said that is bullying tactics and she just won a similar case that way . Also since they help ripped my plants out that its destruction of property. They weren't allowed to touch a single thing but only watch . So we open up a case starting Monday . She said a client she helped win a similar case in Shasta county had much stricter rules than butte and that this is a case she can work with . Also for you growers out there in butte county of they threaten you with fines she said that she's been getting the daily fine stopped until the hearings and that you can get through ur grow season that way . She said the case she just won took 11 months to finish but she was successful . You can't let these criminals rob us and get away with it . I'll keep u guys updated as it goes on . Fuck Deborah fuck the ordinance and let us grow our medicine .

All the evidence they need is a code enforcment person standing at your back fence peeking over or saying they smell weed being grown. A chopper that flew over, etc. They call and ask for the warrant. They slap an address and signature on that baby and its on its way to your door. Just a week or two ago people were arguing these raids weren't going to happen. And still you are arguing they can't do it. But they can and do. Fighting by changing the laws is the only way things are going to change IMO. They have the upper hand in the current system.

And that right there is an invasion of privacy, something a lawyer would point out and case would have to be dropped. They need to build their case legally and lawfully.Hence why I asked earlier if OP let them in. If OP let them in on his own accord he lost any leverage he has, now if they were "peaking over his fence" and barging in on his property without a warrant that is trespassing on his property the law protects him from that. Once again, the lawyer has some digging to do.

Once again state law trumps county law. Just like how Federal trumps State... Your rec is licensed by the state legally allowing you to grow on your property. Yes it is a grey area, but I would fight it, but thats just me.
The state allows 6 plants unless the county says more. If he was growing 18 plants that was still in violation of state law since his location didn't allow that many, and that goes beyond code violations. They may not be able to get a warrant for code violations, but they can get one when they determine you have broken state law. God forbid they say it was cultivation with intent to distribute.

Seeing a violation from the property line isn't an invasion of privacy. I don't know what la la land you live in.
