I think consent of an individual establishes legitimacy, since we know it is illegitimate to create systems or human interactions which don't consider the consent of the individuals involved.
A state which assumes consent without any actually being given, can't be legitimate.

But where was the 18th person that had the same policies, was a non-politician but at the same time knew enough about politics to navigate a presidential election?
