I think you are reading too far into that loophole that says that he can't be prosecuted based on what he tells internal affairs. The county attorney will be the one who decides whether or not to charge him and he has already told the 9news (CBS local) that he will likely charge Noor with 2nd degree manslaughter. He alluded to a preference for charging him with murder since her death was ruled a homicide.
Hennepin County Attorney Mike Freeman told 9News on Wednesday Noor could face a murder charge because Ms Damond’s death has been ruled a homicide.

A charge of second-degree manslaughter is more likely, he said.

‘In Minnesota normally it’s a charge of second degree manslaughter,’ Mr Freeman said.

‘[But] it’s way too premature for us to make that call yet.’

Mr Freeman, who previously argued that the police officer’s body cameras should have been turned on at the time, said his office has yet to speak to the officers.

When asked if Noor and his partner were cooperating with authorities, Mr Freeman answered ‘no and yes.’

Now before you deflect by insisting he hasn't yet specifically filed charges, I'd remind you it is beside the point. The person with the authority to make that call has indicated he is seeking murder charges but that 2nd degree manslaughter charges are more likely. He's only waiting for the evidence. He may have made it sound like it isn't up to him, but it most certainly is. It's his choice so he could not have been alluding to anything other than a personal hope to charge him for the greater crime if he can according to the evidence.

Add to that the fact that an infamous right-wing former member of the house for his district is going around making bigoted remarks and what you have is someone who is not enjoying the "thin blue line" privilege. By all means, now that I have clearly argued my point, you're free to ignore it and any nuance it entails and then insist my anus hurts. It's clearly the easier option for you.

The local chapter of predator hunters terrorized only one minority. The Sitka Blacktail.
