It's your 4th amendment right. If they go in nonetheless whatever they find can't be used in court. So if they do that, find ALL YOUR PLANTS, that fact can't be used in court.

It sounds to me like they were responding to a domestic violence call in which case if they hear anything it would fall under "exigent circumstances" in which case they are going to take the door off its hindges. Also keep in mind that most cities keep a judge "on call", mostly to get a blood warrant for a DUI case but they can and will get a warrant if there is enough evidence.aw man DWR!!! I know you said you dont care anymore... but their right man, dont let them in... even though I do on ocasion but on my terms . you could have ended your life as a free man at that moment.
talk through the door allways, they wouldnt have gotten a warrent. and if they did it would take at least 2 days, and I doubt a judge would give them a warrent because you were wrecking your own house.
even if your wife said they could come in and you said no all evidence would have to be discarded. as in no fine.
you may be able to complain and say your wife objected to the serch and therfor the search was unconstitutional. so unfineable.
on the other hand, even though its a very unlikly hand, you would have had an asshole judge who smokes crack and dosn't pay attention (not uncommon here) whowould have signed the warent and you go to jail, I still wold have taken that chance

cops don't need warrants. they can barge in and do whatever they want. it may not hold up in court but by that time it's kinda too late.
my buddy had 2 bedrooms blown up. cops came over and kicked the door in. said the neighbors called and complained of loud screaming. they thought he was beating his girlfriend. no warrant. they took everything. lights, money, weed, .......... he fought it in court and won but it took 6 months and half his shit was destroyed.
it's real easy to calmly sit here and give advice, but when the cops standing in front of you it's a little different. i start shaking the minute i see them. even if they are here to help me.
Its really tough to get any kind of minor conviction on an exigent circumstances call. I mean if they barge in and you have a meth lab, kiddie porn or anything violent is going on expect it to stick. On the other hand if you were growing pot, had a small amount of blow or maybe an illegal cable box you will be fine (in the long term). Just like when the DEA raids dispensaries they rarely actually take the case to court, they just take all your pot, equipment, computers and money as "evidence".
