MMAR and other legalities

So I had a run in with the cops the other day and got me a little nervous about things, so thought I would check in here.

Maybe I am totally out of the loop and can't find any recent news, but are MMAR grandfathered licenses still valid? (sorry if this has been covered 1000 times...)

I was stopped at roadblock where there were about 20 officers with 10 cruisers stopping everybody and checking their stuff. The officer gets my license and reg and goes to his car for a minute, then comes back and says he smells mj in my car. I tell him I don't think so (luckily I was right!) and the first thing he says is I'm placing you under arrest for possession of a controlled substance. I have my 3 yo daughter in the back and am on my way to pick up my son from school. WTF. So I get out, he reads me my rights, asks if I want to call a lawyer, then searches me and my car, turning up nothing. I tell him I smoked some about 4 hours ago, just to get him off my back, and he lets me go. Scared the shit out of me though.

So, a couple of things... Was this correct process for the officer, arresting me based on suspicion before actually finding anything? Does he need a warrant to search my car if I refuse? I was pretty sure I had nothing there, so I let him, so as not to cause a scene. Is it possible that I have been flagged due to my involvement with MMAR? Will this incident be recorded and available for the next cop to pull me over? Never have had any run ins with cops for over 20 years, since I was a teenager, no charges, one arrest for shoplifting when I was 16. I'm a normal looking working dad. Isn't this 2018? Aren't we legalizing this stuff??

Anyways, I was pretty blown away at how quickly he arrested me and did the whole thing, with my daughter in the back and everything. Got me kinda rattled...

Are they going to be cracking down on everybody before legalization??? :neutral:

They are grandfathered under the supreme court of canada
but not all cops cold give a rats ass
they can do anything they wish

you have to defend yourself always.

I think you would have a good case to sue given your breakdown of the situation but I am no lawyer. I know cops though and some cops act like they can do anything they want, like arresting you for no reason even with no cause, but it takes a lawyer to sort it out or you have to know your rights. Sometimes they beat you just for asserting your rights though. Fuckin cops.

OK cool, I didn't bring up the license, though I always carry it, just because I knew I had nothing with me and didn't want to open up any cans of worms.

Any ideas on how long will the MMAR will go on for? Are they planning to cancel them once the new regs come in?

The Allard MMAR Injunction remains in effect until Justice Manson rules otherwise. The Fed’s would have to bring it back to court to have it lifted. The proposed legalization framework calls for readdressing MMJ as a whole in 5 years. I’m pretty confident MMAR will be good for a while.

As someone has already said, always carry your pinks and when questioned about possession or even smell, show them the paper and they have to back off. If they continue to hassle you, inform them that ignorance of the law is not a defense for their actions. They are paid to know the law, and you have the right to be free from harassment and threats of arrest when you are an innocent person. Throw it back on them.

I have a friend who has mmar papers, he has moved since then and his address is now different . Is there anyway for him to change the address? I told him he should buy his old place because his plant count is huge, it could be a good mine.

Would it be smart to have a pic on your cell phone or a photocopy? I prefer to keep my ACMPR registration at the grow area.

With ACMPR there is only the copy for the grow. They do not provide lables for your home grown product. My understanding is to carry legally, it still has to be in a LP container.
I bought the cheapest 5g bag from Tilray.
The child proof container is the same bag wether you get 5-30g. It has my prescription for 2018 on it. Took a pic of the registration on my phone.

If you produce your own there is no way to carry it in LP packaging, I guess you have to make your own lol. You can't put your weed in LP container, that is not technically legal although cop won't know the difference, which is why people say to do that. It is simpler and faster than talking to the cop about your ACMPR grow status etc etc.

After all who wants to talk to a cop longer than they have to.

My pinks were in a fire proof safe needless to say the safe wasn’t water proof and when my basement flooded a couple years ago the safe took in moisture and now I have moldy pinks I did try and save them as best I could. So now I am stuck with a pick of both pinks on my phone
