Does anyone know that if you have 2 people with med cards in Illinois that you could have 10 plants instead of 5? Also what if 3 people living in house had med cards would you be able to have 15? Can’t seem to figure this out.

Luckily Illinois has relaxed laws especially cook county itself. I have seen first hand chicago police throw away my friends bag of coke and not even give him a ticket or anything (it was only a small amount) and have heard many similar accounts from other friends.

"Illinois home grow of cannabis is available to medical cannabis patients in their primary residence – with a limit of five (5) cannabis plants over five (5) inches tall – per household & not per person. "

Oh, I guess I got that wrong, ignore me! I can't read.
The Illinois law is pretty crappy and finding that information is difficult.

HB1438 Enrolled - 41 - LRB101 04919 JRG 49928 b

"A dwelling, residence, apartment, condominium unit, enclosed, locked space, or piece of property not divided into multiple dwelling units shall not contain more than 5 plants at any one time."

What about if you have a pool/coach house on the same property as well? Would that be considered a separate dwelling? What about a locked shed?

A dwelling is a place of residency. People have to actually live there. Outbuildings are not dwellings. A duplex or apartments with separate occupants and addresses could have seperate grows of 5 plants at each address. Property with only 1 address is going to be limited to 5 plants regardless of how many people reside at the property.

Is anyone familiar with laws surrounding the actual use of medical marijuana in relation to your own home? I use it in my garage and my new neighbors have been doing things that make me think they don't like the smell. My understanding is that it has to be done in private. There is no way anyone can see me smoking unless they were trespassing. Any feedback would be appreciated. Thnx!

Im not 100% about your laws but you can smoke INSIDE your closed garage without being harrassed. Maybe if you were in your car and right in front of their home , then yes i could see trouble but just doing your own thing in your own property ,you should be fine.

Weed is still illegal , so it really depends on how local law enforcement and how they feel about weed. (its a quick, easy bust for them but the judge is going to be pissed at them for bringing such nonsense to the court room. ) its a lose , lose for us. Luckily most legal states are being cool about it and even some of the illegal states have become more lax on it but its still an easy bust for the locals or the feds if they want to be dicks.

Thank you! I had hard time finding any specifics on it. I live in small town and local authorities have a tendency to be a-holes. They let authority go to their heads. I will see if they ever show up and ask for the specific law or statute I am breaking. :)

Use is prohibited in:

  • Any public place, such as streets or parks
  • In any motor vehicle
  • On school grounds, with the exception of medical users
  • Near someone under the age of 21
  • Near an on-duty school bus driver, police officer, firefighter or corrections officer
Any person, business or landlord can prohibit use on private property. Illinois colleges and universities are also allowed to ban marijuana use.

I was simply referring to federal laws and local police.

So , yes , you can legally smoke in your garage as long as your landlord dont mind. (you dont tell him) The smell is not your neighbors business.
