Trump's lawsuit was widely scorned by former federal prosecutors and other legal scholars, who said the filing was lacking fundamental elements, such as exhibits, sworn affidavits, or a viewpoint on how a judge should approach the issues raised.
In interviews and on social media, legal experts said the lawsuit was more akin to a press release with the way it aired Trump's grievances against the Justice Department and described the former president as the "clear frontrunner" in the 2024 Republican primary.
On Tuesday, Judge Aileen Cannon, who was appointed to the bench by Trump and confirmed in 2020, seemed equally unsure of what to make of his lawsuit. Cannon asked the former president's lawyers to further explain what they wanted and how they believed the court should approach their request.
The judge ordered Trump's lawyers to respond by Friday with a court filing "further elaborating" on several points, including the "asserted basis for the exercise of this court's jurisdiction," "the framework applicable to the exercise of such jurisdiction," and the precise relief they want.
Cannon also asked Trump's legal team to address "the effect, if any," of a separate proceeding before Magistrate Judge Bruce E. Reinhart, who approved the warrant allowing the FBI to search the former president's South Florida estate.
"It's never a good sign when within 24 hours of filing a motion a friendly judge issues an order demanding you submit more information on why exactly you brought the matter to her in the first place," wrote Bradley Moss, a national security lawyer.

When he builds one he can ask for the records from NARA, but in the meantime the shelves in his personal office at Mar-a-Lago do not count as a “Presidential Library”. Donald Trump is facing a precarious legal situation as his classified document scandal continues to look worse with every new revelation, The New York Times reported on Tuesday.
"Mr. Trump has projected his usual bravado, and raised millions of dollars online from outraged supporters, since federal agents descended on the property more than two weeks ago and carted off boxloads of material including highly classified documents," Maggie Haberman, Glenn Thrush, and Alan Feuer reported. "But something is different this time — and the errant court filing offered a glimpse into the confusion and uncertainty the investigation has exposed inside Mr. Trump’s camp."
Late on Monday, Trump's team revealed an incriminating letter from the National Archives and Records Administration (NARA) sent in May.
"The documents investigation represents the greatest legal threat Mr. Trump has faced in years, and he is going into the battle shorn of the protective infrastructure and constitutional armor of the presidency. After years of burning through lawyers, he has struggled to hire new ones, and has a small group of lawyers of varying experience," The Times reported. "He is facing a Justice Department he no longer controls, run by a by-the-book attorney general, Merrick B. Garland, who has pursued various investigations into Mr. Trump methodically and quietly. Mr. Trump is serving as his own communications director and strategic adviser, seeking tactical political and in-the-moment public relations victories, sometimes at the risk of stumbling into substantive legal missteps."
Trump is going into this battle without the protections of the presidency.
"Now, as in the days after he lost the 2020 election, Mr. Trump is relying on an ad hoc team of advisers with varying levels of experience and judgment, and trying to use his political support as both a shield and a weapon to be aimed at the people investigating him," the newspaper reported. Trump is also experiencing a shrinking inner circle.

"His concentric circles of political advisers, several layers deep when he held power, are also shrinking. That's another predictable action by you. Where did I say that? Go back and re-read my post. I said a former Democrat is selling out to a wealthy Republican who is using her to split the Democratic vote and give Republicans a chance for the first time in decades. That's just a plan fact. It is a neutral statement. She can't win. But she can help a Republican win. Even with Phil Knight's millions in contributions, the race was rated at most a toss up for Republicans. And THAT was before Republicans took away women's reproductive rights. As I said, come back in October when people start paying attention to the candidates.
