if im a legal patient and i rent a house can i grow medical or can he kick me out if he knew... is it up to him since its his prop or since its not on the lease he cant????? plz let me know
They wouldn't advertise it if they had a clue just how big a risk they are taking.the landlord cant be prosecuted for providing you a place to live and grow if your a legal mmj user. now if you paid him in mmj or he charged you more for growing mmj or something like that then he could get in trouble but in reality he is just providing you a place to live.. go to craigslist and search the housing for prop 215. you will find tons of landlords that advertise "prop 215 sb 420 friendly" they wouldnt advertise it if it was such a risk

Try doing a little research on property seizure laws before you go armchair lawyer giving advice that could get someones property taken by the feds.
The owner of a rental property (or any other physical property used in a crime) does not have to be aware of the property's use in a crime to have the property be subject to seizure. The feds say they would never take an innocent owner's property but do some searching and you'll see its WAY more common than you think.

To the OP, Just because it's "legal" in CA, doesn't mean your landlord has to allow you to grow it on his property. Doesn't matter if it isn't in the lease, he can still take you to court and try to have you evicted.
How do people manage to grow cannabis, then? Well, they probably OWN their homes or rent from 420-friendly landlords.

In '96 the U.S. Supreme Court ruled that property used in a crime can be seized for forfeiture even if the property owner is innocent of the crime. Being innocent of a crime also means having NO KNOWLEDGE of said crime. This exact situation has already happened where some old lady who was renting property to someone engaged in drug related activities had her property seized because they busted the tenant. She had NO KNOWLEDGE of the crime and still lost the property.
Growing marijuana is illegal under federal law. Fed law trumps state law. That's not the way it's supposed to work but that IS how it works.
Now do a little more fact checking to see that the feds are STILL busting people for pot in cali. As are local govts in Cali, just ask people like Eugene Davidovich.
