DEA still targeting MMJ growers/distributers

hey so i just saw this article and figured id post it in case anyone hadnt seen it, ive noticed people getting more and more relaxed with the current state of affairs MMJ wise to the point of someone posting pictures of stacks of bills asking for a "legal" large scale purchase, and just wanted to say dont get too comfortable! oh also probably dont respond to that guys post :eyesmoke:

Yeah we have had 2 caregivers busted here in denver in the last few weeks, they also raided a lab that was testing thc levels for the dispenseries, the most recent they got 150 plants that were huge 5 to 6 feet tall

I've been telling people for months that it was bullshit, that they would start coming after MMJ patients, dispensaries, growers and the like. Just because it's legal at the state level doesn't mean shit to the federal govt. They've succeeded in lulling people in medicinal states into a false sense of security. It's a dirty trick on the part of the govt. but people need to realize that just because it's legal on the state level means absolutely nothing to the feds and they will start coming after patients and dispensaries as evidenced by this article. It's complete bullshit!!!:cuss:

But good thing I'm in Cali. DEA wont hit this place people will go nuts. There might be riots no joke haha.

denvers mmj scene was one of the first and is one of the strongest, the dea has and will continue to raid places in cali until/if weed is actually legalized - medicinally or otherwise, until then its a risk to grow and an even bigger one to grow with a false sense of security

That's exactly what I've been trying to tell some of these people in MMJ states that think they can't get into trouble. The only thing Cali has going for it is the sheer number of growers. There's so many that the DEA simply can't bust everybody. Obviously Obama either lied or he doesn't have control over his own people. Either way it just goes to show that virtually no politician can be trusted. bongsmilie

Isn't there a minimum # of plants involved in a cultivation charge before it's a federal offense? And if so, than wouldn't there be certain # of plants before you could actually be charged by the federal gov't and not by the state?

Under federal law posession of any amount of cannabis is illegal. They can choose to bust whomever they wish. It's illegal under federal law, period. That being said they typically go after the biggest and baddest. Maybe they aren't aware of the biggest because the big guy keeps his trap shut. If you are going to be going on tv bragging about your shit then you become a target, plain and simple. This guy got lulled into that false sense of security. He thought that just because he was legal under state law that the feds couldn't touch him. Wrong! They do what the hell they want when they want. :cuss:

in principle, you could be charged federally for a minute amount of cannabis material
it's against federal law
now in practice, only larger situations get federal attention
i hear 100 plant threshold is pretty common for a DEA interest in your grow
but that's an internal policy, DEA could come after you for 1 tiny seedling by the law as it stands

Not they would waste their resources like that but I doubt they could. Because you aren't committing a federal offense and your state govt can't charge you.

it's mostly state enforcement except for large amounts/# of plants
but as screwy as it sounds, the DEA could come in to your house, find a 1/4 ounce of MJ, and charge you
federal laws haven't changed in a long time
now they won't, and federal judge would likely toss any such case

well i am going to grow my own meds and if they want to charge me than go ahead it will only look bad on them since I am following all my state laws and don't hurt nobody. BTW who doesn't live near a school.....I mean seriously where do you think our kids are?

Well, thousands of people around the world read these posts. I am an active member of NORML and MPP. I do feel strongly and am very active politically. I do my homework and try to vote for people who favor decriminalization or re-legalization. What have you done? :eyesmoke:

As a person that has actually served 3 years in prison for posession of 3 oz's, (back in the 80's) I want to remind everyone that fed law has a mandatory 5 year sentence for anything over 99 plants, which is why the DEA likes 100 or more plants!

With the way Colorado law makers are changin things recently it is apparent that they are paving the way for big money (corporate) growers to take over, it is possible that the DEA is helping with this goal by eliminating those in the way???

It's mainly about siezures. The more money and property they can sieze the more motivated they are. If they feel like you have something they can take, you're screwed. :neutral:
