so i live in california and am a legal grower but theres a problem, next week my landlord is having an appraiser come by as he is refinancing, my question is if the door to my spare bedroom is shut the house looks normal so im wondering if i can just lock the door and say its my roomates room and i cant get in or its just storage and i lost the key... can they still do the appraisal if they cant see one room... i have a floor plan for the place so they can have all the measurements and stuff but im wondering if that will work... im in week 4 of flowering so its either destroy the whole crop pretty much or try and bluff my way through... has anyone had to deal with this beofre

I don't live in cali... (whew actually).... and I don't know your state rights.... BUT as a course of business.... if it was say, the property assessor for the county taxes ... i would say you have no worries.... BUT....your landlord is asking basically to restructure a private loan .... they may very well indeed insist on seeing the entire house.

Tax appraisal is much looser than a bank appraisal..... Maybe someone who has encountered this will come on.... but in Florida..... you would be sweating it.

I think your plan of just saying "Oh, another bedroom my friends and he has the key, sorry" wont be an issue. Just make it sound like its hard to schedule your time with the landlord but still do it and get it done and over with.

Make sure you cant see glowing red lights through the floor of the door, too. That'd suck. :)

if i was you i would lock that door and tell them what you said, its your roommates and you dont have key, just tell them to come back later, witch they won`t if the apprisier is already their. iand doubt they will force it open, unless your landlord is a dick. i hade an appriser come by here once when i fist moved in, dident have a crop in yet but one room door was stuck and he dident even bother with it, but i would still be very very very careful my friend, even if u grow legally.

Well, not too deep, since ur legal,,,, but the land lord may boot you.

the landlord wont be there because he lives far away...i used to live here with my gf when i first moved in so i was thinking of saying its her room being we broke up and shes never here thats why its locked... im just wondering how important it is that they see the room.... the rest of the house is totally cool so is it possible they will be like whatever

geez you got me wondering now. thats something i can see my landlord doing as well. im also legal, does cali law state anything about landlords and growing in their homes? on the michigan website it says under faq:

Question: Do I have to tell my landlord that I am a patient in the MMMP? Can my landlord evict me if I am a patient in the MMMP and have my grow site in my rental housing? Can I live in subsidized housing and be a patient in the MMMP?
Answer: It is up to you to decide whether or not to tell your landlord that you are a patient in the MMMP. Nothing in the MMMA specifically addresses whether or not you can be evicted because you are a patient in the MMMP, even if you have only the amount of medical marihuana allowed by law. Nothing in the MMMA specifically addresses whether or not a person can be an MMMP patient and live in subsidized housing. If you have questions about these important issues, you may wish to talk to an attorney to learn about your rights and protections.

but hes legal. the worse that happens is a simple eviction but i think that can be fought and at the least get your security deposit back. take the security deposit and your first harvest and get a house with a landlord is 420 friendly.

I was just wondering. If you are legal why are you fucked. Is it in your rental agreement NOT to grow weed? just show em your card.

I am a land lord with a couple rentals. I had to learn the law out of necessity.

1) The landlord can and will have the right to inspect the entire premises with sufficient notice as put forth by your rental contract. Just about every rental agreement has this clause.
2) The appraiser has to measure all the rooms in the house - they cant simply just go by a floor plan, or they would have already done that since each home is described in great detail at the County Recorders office.
3) The laws regarding the cultivation of MJ in a rental property is still in hot debate. Essentially, the landlord can state that growing MJ inside your home is not acceptable use of the premises and places it, and its inhabitants, in unsafe living conditions (fires, etc.). He can demand that you correct the unsafe conditions, and if you dont, he will evict you. If you comply with the demand notice and/or move out, you wont have an eviction on your record.

At the very least, he can call the police and complain and they will come and confiscate everything as evidence and you can play hell trying to get it back when you prove you are legit - of course when you get it back, it will be dead and unusable. You are better off not fighting that losing battle in my opinion.

Soo... what you do it this. Get a storage shed or use somebody's home that you can store it for the day, and move it covertly. Move it back when you are done. I know its not ideal, but hey, you took a risk and the alternative is that you toss it all out.

I do my share of appraisals in Michigan. Here, we want to see every room and take a photo of it (by law). These photos go to the bank in the complete report. Without them the bank will reject the appraisal. These laws vary each state. And some appraisers are more lax than others. If it were me, id make you open it. If you offered to come back later, I would do so and just charge the bank for another trip fee (dont offer that, they'll prolly take it). Im gonna go with move it for the day... But who knows, try the girlfriend thing and if they say they'll come back later then move it. You could even then move it to a garage or basement, somewhere thats already been inspected and photo'd.

This idea depends on the size of your grow as it would be harder for large grow but if it's small you can hide the plants either in a closet or your car. Just put them in black garbage bags for 24 hours and take down the grow equipment. But like I said this will work if you only have a small grow, if you are using the whole room and have a complicated set up then it's probably not going to work well.

How do you get along with your landlord? Do you pay rent on time? Get along with the neighbors? Keep the yard kept up? Keep the house clean and in good condition? I personally think especially in cali these would be some weighing factors, i mean in illeagle states you would be fucked and forced to rip everything down but if your in cali and legal, get along with your land lord and do all those things above i think you will be alright, Id honestly be more worried about the possiblilty the appraiser is a pot head and its gonna be hard gettin him to leave after he see's the plants..
