GRAND RAPIDS – The medical marijuana crowd, already upset that state Attorney General Bill Schuette won't fight a federal subpoena for medical marijuana records, isn't going to like his latest legal action.

An opponent of medical marijuana, Schuette is backing the Grand Traverse County prosecutor's effort to convict a medical marijuana user of impaired driving. Schuette said the law provides limited protection to legal users, but does not provide protection to those driving with marijuana in their systems.

“Michigan law makes clear that driving with drugs in your system is illegal,” Schuette said. “Allowing anyone to do so puts the lives of our families and friends unnecessarily in jeopardy.”

Schuette filed a brief in support of Prosecutor Alan Schneider who charged Rodney Koon with driving under the influence. A county circuit judge upheld a district judge's ruling that jury instructions at Koon's trial would not say that any presence of marijuana in Koon's system was sufficient for conviction.

The prosecutor also disputed judges' rulings that, under the medical marijuana law, the prosecution must prove the driver was under the influence of marijuana. State law says any amount of marijuana in a driver's system is illegal.

Koon was stopped for speeding on Feb. 3, 2010. After police found a pipe in his pocket, :clap:he showed police his state certificate, the Traverse City Record-Eagle reported.

The Record-Eagle said Koon said he smoked marijuana six hours before he was stopped. He has several ailments, including herniated discs, a pinched nerve in his neck and rheumatoid arthritis, the newspaper said.

The county prosecutor is appealing the case to the state Court of Appeals.

Schuette was a vocal opponent of medical marijuana, which had support of 63 percent of voters in 2008.

He has taken shots from medical-marijuana supporters for his stance in a case in which the federal government is seeking state medical marijuana records as part of an investigation the Lansing area. Schuette said he would turn over the records with a judge's order.

It prompted Traverse City attorney Jesse Williams, representing Michigan Association of Compassion Clubs and unnamed patients, to take up the fight. He said the records are supposed to be confidential under the medical marijuana law.

He said in court papers that Schuette “has a clear and unambiguous conflict of interest” based on his opposition to medical marijuana.

That case is pending before a U.S. District Court magistrate judge.

Government leaders are always smarter than the masses they rule over.
Majority means nothing in politics today. Your vote doesn't matter, especially if
it doesn't conform to the moral compass that guides our country's rulers.
Isn't it obvious from the state our country is in both economically and socially that
our rulers are the smartest ones in the room?

Ya know, I read a bit more about this man's case and I need to add this... A case like this is a dream for jack wagons like Schuette. Our community has to support him because we'll potentially all be violating the law whenever we drive due to the long life of metabolites. But we'll look like fools because he also had alcohol and a couple other substances floating around in there. My sister was killed by a drunk driver, so Mr Coon does not have my support. Neither does Bill-S either.

just like your not supposed to drive on vics, or any prescribed narcotic. i for one am extremely against operating under the influence of anything. i was prescribed vicodin for my cronich kindey stones and severe pain i live with all the time from them. i was recently prescribed medical pot and have found it to be much better for me than vicodin, no nausia and no pain, also i have bleeding ulcers and it is to help increase my apetite. i for one dont want to lose that right because people are out there gettn stoned and thinking its cool to drive... i have kids id like to see them grow up. stay off the road if your stoned. for the safety of our communities and our right to smoke!

To date ..., seven studies using culpability analysis have been reported, involving a total of 7,934 drivers. Alcohol was detected as the only drug in 1,785 drivers, and together with cannabis in 390 drivers. Cannabis was detected in 684 drivers, and in 294 of these it was the only drug detected.

First off dan, this guy wasn't even high. So your simple solution is pretty fucking stupid. Big difference between having marijuana in your system and being under the influence of it. If this precedent is set, nobody with a MMJ card will be allowed to drive. Pretty damn stupid if you ask me. Especially since study after study has shown, statistically drivers under the influence of marijuana don't drive any worse than those that are sober.

Driving stoned simply isn't one of them.

I do not carry anything on me, and everything gets put in a smelly proof bag when traveling.
Such carelessness is to blame, not the laws.

I have never had any problems.. alcohol is much more dangerous, and affects your capabilities way more than MJ does. hell coffee affects me worse when driving than weed. all jittery and shit. fuck that.. to all you haters saying dont operate machinery while on weed. you are the ones making it look like a goddamn narcotic drug. exacly! but since there is not.... dont. simple as that. and i am not saying the old timers that do this every day and the medical patients as myself, are the ones that are getting pulled over with paraphernalia and bloodshot eyes... we are the ones that dont need to lose this right because there are kids out there driving around stoned... the "clambake" was the shit in high school... the guy was in the wrong. if he carried his pipe in a proper bag in the trunk and not in his pocket... hard telling when he finished it.. they might have let him go.

the law is clear its a mind altering substance. to your limit and mine not so much, to the wrong person thow its powerful shit. "high" is to be determined by the consumer... i can smoke a joint and not feel a thing... my mom would pass out.... simply put dont do it. dont carry, if you do not were its easy access. dont drive blown out stoned. they wont believe you... he oly said it was 6 hours. they dont know that. and they didnt believe him for a reason. might be the box of doughnuts and bloodshot eyes... i love weed. its a godsend. lol but thats my point. dont fuck it up being silly with it

He may not have felt high or even seemed impaired, but he sure isn't the right case for our community to put there support behind. i got a simple solution. dont fucking drive while your stoned.
Um, THC metabolites can remain in the body for a month or more depending on usage and body weight. What the test sees is not active THC but a metabilized by product of it that is NOT active. You smoke the 1st of the month, get pulled over two weeks later and piss/bleed dirty you are deemed stoned/drunk/disabled.

DAMN! Sorry to hear that and I am positive your not alone there. Many have loved ones killed or maimed by a drunk behind the wheel. But it is acceptable to society it seems.

by that idea then cocaine (comes from the coca plant) and heroin (comes from poppys) are not narcotics... dumb ass argument bro. its a known mind altering substance, period. big black dot. to you it might be a mood enhancer or less.. to my 14 year old kid it is a drug used to get high, to my wife its a blackout in a paper. lol im 100% for pot for medical use AND for recreational...to those that are of age. wich i feel should be set like cigs or alcohal because you grown ass men should be able to hold your own... but not everyone can, and those are the folks making it dangerous. i know people drink and drive daily without an accident.. but the one time they aint all there someones gonna die from it. so im for pot, all for pot, but until its set and were not just fucking things up for those that need it, and enjoy it, follow the laws and do your part to fix what you dont like about it.
