Do you have to wait another 21 days after signing up with a caregiver?

Suppose you are already legal paperwork wise. If you finally find a caregiver, do you have to wait yet another 21 days before you can get your meds from them?

Some guy who I almost went with as a caregiver told me this. Is this true?

Answer: The MMMA defines a "Primary Caregiver" as a person who is at least 21 years old and who has agreed to assist with a patient's medical use of marihuana and who has never been convicted of a felony involving illegal drugs. Therefore, the qualifying patient (applicant or registrant) and you must complete a "Caregiver Attestation" to be submitted by the qualifying patient.

Sec. 9. (a) If the department fails to adopt rules to implement this act within 120 days of the effective date of this act, a qualifying patient may commence an action in the circuit court for the county of Ingham to compel the department to perform the actions mandated pursuant to the provisions of this act.
(b) If the department fails to issue a valid registry identification card in response to a valid application or renewal submitted pursuant to this act within 20 days of its submission, the registry identification card shall be deemed granted, and a copy of the registry identification application or renewal shall be deemed a valid registry identification card.

Since you are submitting a new app, being the change of caregiver form, this is the administrative guidelines that one should follow.

No you do not have to wait another 20 days to buy meds from them. You are already legal. You can buy meds from whoever you feel like, legal or not. Good thing you didn't go with that guy, he sounds like an idiot.

He can buy from whomever, but for the CG to be protected he needs to wait the 21 days as said in the law.

Depends on the city. Different city councils enforced different rules on patient/cg relationship, but if both parties are discreet and responsible in their actions there shouldn't be a problem.

You as a legal patient are protected to aquire your meds anywhere. It is the other party to the transaction that is in question.

no. if you are past your 21 days since your check has been cashed by the state of Mi, you are legal to obtain meds.


he maybe referring to if you NAME HIM as your Personal CG, then he may have to wait 21 days or until its OKed by the MDCH.
but for the meantime, you can obtain meds from any Pt or CG that is offering overages. just have copies of all your paperwork to prove our past the 21 days since your check was cashed, and a copy of the said "Cashed" check.

Only problem is that for a caregiver, there is no way to verify if those documents are legit.
