No, nooo, not Florida unfortunately. He said he had almost a half pound jar. It's good that there were less than 25 plants which would land you with a possible 15 years felony for intent to distribute. It's also good you had it in 1 jar and not multiple bags for same reason. You did however have more than 20g which is a felony with maximum 5 years incarceration and $5,000 fine. I just hope you were not located within 1000 yards of a school or park. If you have a clean record and an expensive lawyer hopefully you'll be in for less than a year or maybe "buy time". Unfortunately you will have a felony on your record now.
Your drivers license is probably going to be suspended for at least 6 months and up to 2 years for some arbitrary reason.
Possible they might get you a second charge for paraphernalia if you had a used pipe or ash tray around and maybe the grow equipment.
That notebook is not going to be proof of a previous grow but it cant help.

So yes people do go to jail for felonies in America.

Might I ask how on earth they found such a small grow? You couldn't have been using too much electricity so my guess is that you indirectly turned yourself in or invited the police over to see it in some way.
A little study I did a while back (not decisively) ranked the top causes for grow busts as 1 stealing electricity(very easy to catch), 2 fire, 3 anonymous tip (now how could the tipster find out I wonder), 4 robbery of grow house (usually reported by neighbors). I was surprised how common fires were and how comparatively rare high electricity drain or areal IR imaging is.

hey i grow weed in a closet at my mom's house. that is because i pay rent, i pay the electricity and she doesn't care..she smokes with me some times..
but i'm in california so its ok for medical use and we both benefit from it.

Oh, and lastly.. I actually could give out some really good legal advice. Just so happens my father is a well known Judge. Started out in the Federal Courts as a Federal Judge.. he was in that section for about 10 years. After serving 10 years as a Federal judge.. he moved down to state courts. He did that for about 10 years... then moved down to Circuit Judge.. was Circuit court Judge for about 5 years.. then moved down to do 'Workers Compensation' which is on the state level I think (not 100% on that). He's retiring this coming June.. just found out that the state is actually throwing him a 'retirement party'. Governor of the state will be there.. the mayor will be there.. pretty much everyone that works for the state/government (except for the President of the USA) will be there (and thank God Obama isn't attending.. I'd be forced to probably bitch slap him like someone should have done years ago).

Keep your mouth shut and do not turn State's evidence AKA "snitch" even if your lawyer says it will keep your record clean (unless you know an asshole selling crack to kids). Don't let homeboy a couple pages back scare you about state law, you will get a slap on the wrist. It may be a hard slap, but a slap nonetheless. Get a lawyer, even if it is a good public defender. People will talk shit all day about a public defender, but sometimes they can work a deal that pay attorneys cannot...hell they have so many cases that they are always around the DA.
Here's my story. My weed man and friend of four years (we'll call him Splinter) got in trouble for two controlled buys on misdemeanor amounts of high-grade mj. They hit him with multiple felonies. He got the best lawyer in the county. This lawyer was so good that even after he dropped a ball of coke in front of a judge, he was still the best. Anyway, Splinter told me that the lawyer got him off of it. Well time had passed and he wanted some opiates from me. He had always done me well, so I did a couple of transactions in a parking lot. A year later, I was living half way across the state and Splinter called me up. I was glad to hear from him. He called me once and when I called him back to see when we could meet up and chill, he never answered. A few weeks later I got into an argument with an ex-boss over a pay dispute and he called the cops. The cops were just gonna write me a no-trespassing citation until they ran my name. Twelve felony warrants popped up in the county I had moved from (secret felony indictment). I was arrested and taken downtown where a "gracious" bail amount was set at $200,000. I was freaking out and after being extradited back to the county of the crimes, I found out what I was facing if I went to trial and lost or if the judge wanted to be a jerk. 5 year mandatory minimum sentence for trafficking heroin times twelve charges. 12 charges x 5 years a piece = 60 years. This is what my public defender told me. He said they don't run that type of sentence concurrent, they box-cart it (run one after another). I sat in jail for a few weeks and got the "motion for discovery" and my lawyer asked me, "Do you know a Splinter?" I was shocked and angry. That little bastard got out of it because his mommy and daddy had money and his lawyer told him to snitch. Anyway, after another couple of weeks I told my lawyer that I would plea to two counts of Sale and Delivery which carries no mandatory prison term. I went to court with a closed plea (Which means it is in stone and the judgement is final) for what I asked for. I got six months intense probation, three years total supervised and fines/restitution of a few grand. Not bad for a guy looking at growing old and possibly dying in prison. My $478 public defender got me a better deal than the $30000 dollar lawyer said she could get me at the consultation. Keep your head up and make yourself look as good you can in the meantime. If your record is clean like mine, your attorney has alot of wiggle room on a plea bargain.

I run alot of strains ,I only flower about 35 plants but I had 24 mothers and about 15 clones and my next crop vegging.I will be charged with manufacter for resale and maintaining a dwelling where drugs are bieing manufactered and sold.Ive grown thousands of plants over the last 6 years,my room was only down two months in that time and that was aphids.Dude I am a two time cancer surviver and I also have liver damage from chemo and all the narcatics Ive taken.I still cant hardly eat to this day.
The reason they searched my house with no warrant was they said they looked in my window and saw paraphanalia after they found me with jars while deer hunting,and no I was not poaching or tresspassing.He pulled up on me opened the door and drew his gun!!!About 30 minutes later they asked me for a warrant and they were standing in my grow allready.These cops here think if you have weed in jars your growing it!!!My lawyer says the search wont hold up..I sure lost some good genetics,

Man try not to stress out to much. Florida is Harsh with their Marijuana laws without a doubt, I live there myself and it's no joke getting caught. Personally I've never been caught for a grow or know anyone who has been caught with a grow. Though I've had many-a-friends get busted with weed around here. They all got the better ends of the stick in their own situations, I hope the best for you my man.
I agree with this. You gotta stand up, without a warrant they can't just barge into your place and begin searching. In that situation, though it may seem like you can't, you most definitely CAN say no. and it's probably be of your advantage to do so.

Dude they put me in jail and then went to my home with no one there,they let thereselves in(No ONE WAS HOME)How in the fuck can you consent to a search if your in jail,I sure cant answer my fuckin door....Brilliant...I have been growing since the late 70s do you think I dont have some security?think..

Well then something is wrong here man. The cops are doing as they SHOULD NOT. I'm not one to say that the legal system in this country is fair, but saying things like this in court may get you off easier, I'd hope so at least. I've heard of cases getting dropped solely because the cop fucked up, they didn't have the right to search your shit if they had no warrant. Tell the judge this and hope for the best. Honestly I wish I could help a lot more, it's a shame to see someone getting busted over a harmless plant!

That is how they do it in my state. If your arrested for possessing a controlled substance, they usually get a warrant to search your home for more drugs and your still locked up while this is going on. They go with the idea that if you had some on you, there must be more where you live.
