CO Caregivers: Do Chores or Get Arrested

The state Board of Health today adopted major new rules for Colorado's small-scale medical-marijuana providers, over the objections of cannabis advocates who said the rules are too harsh.
The rules will require that caregivers — medical-marijuana providers serving five or fewer patients who cannot grow for themselves — do more than just give cannabis to patients. Instead, they must also do something extra, like help patients with shopping, cooking or getting to doctors' appointments.
Medical-marijuana advocates fear the added responsibilities will severely trim the number of caregivers, which state officials said today stands at 16,000. The advocates say caregivers provide a link to medical-marijuana for patients who are poor or who live in areas where there is no convenient access to dispensaries.
But Health Board members said they do not think the regulations present the doomsday scenario that advocates worry they do.
"There's a lot of things caregivers are already doing that would meet this definition," Board President Laura Davis said at today's hearing.
The rules will not affect dispensaries, which serve large numbers of patients and are regulated by separate laws.
Caregivers are required by the state constitution to have a "significant responsibility for managing the well-being of the patient." What, exactly, that means has been the subject of a years-long debate, played out at the Board of Health, the legislature and the courts. The new rules were intended to settle the debate.
Law enforcement officials said the rules are needed to help them better differentiate between legitimate medical-marijuana caregivers and illegal drug dealers hiding behind the claim that they are caregivers. Neal Richardson, the chief deputy district attorney in Denver, called such a clear separation "the linchpin in our enforcement efforts against people who are dealing drugs."
Having rules that require caregivers do extra work for their patients would allow police to ask purported caregivers about that work to help determine whether they are legitimate, said Ernie Martinez, the president of the Colorado Drug Investigators Association.
But medical-marijuana advocates said such an approach would allow law enforcement to intrude into patients' medical care, and they questioned why state officials would want medical-marijuana caregivers providing services that others are better qualified to provide.
The advocates said the rules misunderstand why patients have caregivers.
"We're looking at cultivators being required to do all of these other things when what we really want them to do is be cultivators," said Shannon Gass, with the Grand Junction-based group Cannabis Consumer Health and Patient Advocacy Association.
Gass wondered whether caregivers could simply help patients coordinate other aspects of their care — like transportation or cooking — rather than being directly involved in those things. Board members said they thought that would be enough to meet the new rules.
Still, a number of medical-marijuana advocates said the Health Board was creating too great of a burden for caregivers, many of whom say they work virtually for free.
"I make no money doing this," said Michael Marcella, a caregiver from Colorado Springs. "I'm going broke doing this. I'm doing this because I care about people."
The Board approved the new rules unanimously. They will take effect next month.

Left CO recently because it is headed in a very shitty direction. Four years of recklessness and carelessness by the government who fucks up everything state or not. CO is the only for profit state also. Pretty fucked up.

Why can't the fact we provide them with medicine and the patient feels that we are the best source for what they want be enough? My patient is my brother and if I don't have a significant responsibility for his well being by just that than IDK who could qualify. To run errands is out of the question he lives far away, I just save him money thee clubs would have ripped him off on. It's all kinda dumb anyways, are they going to interview us randomly? What is going to stop the "illegal caregivers" from just lying? Do they expect the teller or the doctor to write a note explaining how their caregiver AKA competition brought in the patient or customer to run errands? Then they will colaborate the story with said individual and patient? Get real!!! Just more wasted tax dollars, let's all wave to it.

these are pretty bias IMO. Isn't a mmjc a large scale caretaker? I mean c'mon, its a lot of rethoric and political jargon if you ask me. Can you imagine large mmjc having to cook dinner and take its patients to work in the morning? Anyway I for one am officially LOOKING for a good caretaker.. I need: rides to and from work, all fo my meals prepaired kosher, my house cleaned twice a week, dog walked, shoelaces tied and all of my food chewed for me. Oh and top quality bud. Any takers?

My caregiver doesn't do any of that, she grows half of my plants for me (for a price), I grow the other half. She also gives me clones for free. I would never expect her to take me shopping the woman has M.S! I've taken her to the store and to appointments for a small green fee. People don't realize that care takers have medical problems too. F&%$en Colorado

I love Colorado and if you make "a living" growing weed, what's running to the store once a week? You hit the hydro store regularly for your plants, but don't want to help another sick person out? Obviously YOUR patients would have to WANT this for it to happen. The state isn't going to force you to take someone who DOESN'T WANT TO GO to Blockbuster with you. Talk to your patients, if they don't want extra help, you're fine. If they do, well that's what you get!

What is really fucked up is that "non-profit" clubs in other places charge way more than the evil for-profit places.

Funny out here in SoCal where I just came to from CO, I see ozs in these non profits charging $200 and it aint shit either. Plus at that price they deliver to you free.

How is it fucked up to want money for growing weed? I see people selling corn and other veggies they grew in their yards on the side of the road all the time. If it needs to be done, someone needs to get paid for doing it.

I highly doubt that I could get a $200 oz every time in CA, but if that's the case then we're finally seeing saturation of the greens market. Probably why I see more and more people mailing shit to the east coast. Legalization is around the corner!

Thats like saying the chemists a Pfizer should have to take all the old men who use Viagra to Wal-Mart or cook their dinner. This is the most assanine thing I have ever heard!! I will take my patients to the doc or whatever they need, but that costs extra. Meds are separate business. Ever heard of anybody gettin a free ambulance ride? Nope, so if they can charge for their rides I can charge for mine, and all you that say its no big deal are prolly schemein ass patients who need a ride and ur house cleaned. This is why I don't want the government involved, they RUIN everything!!

Yup that's why people mail shit there. The reward outweighs the risk... and the higher the risk the greater the reward. Personally I wouldn't fuck with the fed's like that but that's just me. Colorado votes on legalization this fall. That's gonna CRUSH prices locally, "exporting" is gonna go through the roof. Get ready for an influx or product

Do Chores, FILE PERFECT TAXES (NO DEDUCTIONS, all reciepts), Actually Bill your patients the LEGAL WAY (not just selling them a zip for $200), Set Up disposal processes ($$$), Set up Surveillance/Security ($$$), comply with Investigations and put up possible behind scenes harrasment, and somehow you can't make money/pay bills, you gotta break even every month or your charging more than your costs. Oh and you can't take a salary so your doing caregiving to actually help sick people, not profit off them.

Thats being a caregiver in colorado. A 100% Selfless caregiver

How many rings of Little Ounce Dealers exist in Colorado, ALOT! The GOV knows this, they are plotting every second how to make it harder for drug dealers to be caregivers.
the model was put forth so Wife could grow for disabled husband, not so Grower X can have 2-3 Dealer friends and 1-2 Sick people supporting his Growing weed lifestyle.

Were only safe for now, they are preparing, and worse we gave them the power, so good luck my friends.
