Selling excess to other caregivers/dispensaries

Wow..I was looking through the new legislation for something, don't remember what now. But I came across the section that allows caregivers to sell excess medicine to other caregivers or to dispensaries.

I thought they had removed that in debate, but I guess they put it back in with their last minute amendments, eh?

On the MMCM website the breakdown of changes says:

"Problems that need to be addressed: - Ban on caregiver cooperatives.
- Unreasonably low plant limits.
- The new law allows a caregiver to give excess marijuana to a dispensary, but does not allow any reimbursement from the dispensary to the caregiver."

Ok but that is not what I read yesterday, and I was at maine.gov, in the legislature I believe. It specifically said "sell". I'll find it and post a link.

Found it. Here is a link to the PDF of LD1296. The same page that had the link to the PDF had a link to bill status, and it said Passed to be enacted, so I am pretty sure I am looking at the right thing. Easy enough to find anyway. Here is the link:

Now, go to section 2423-A: Authorized conduct for the medical use of marijuana
Section 2: Primary caregiver
Subsection H: For the purpose of disposing of excess prepared marijuana, receive resonable compensation for the transfer of marijuana to a registered dispensary or primary caregiver.

I suppose someone will argue that they are just talking about the transfer part (i.e. gas money) but that isn't how I read it.

H. For the purpose of disposing of excess prepared marijuana, transfer marijuana to a registered dispensary or another primary caregiver if nothing of value is received. A primary caregiver who transfers prepared marijuana pursuant to this paragraph does not by virtue of only that transfer qualify as a member of a collective.


this is the law that passed....seems pretty clear to me

Well, I just have one thing to say to that:
