City ordinance code enforcers for clinics

Hi, my wife currently works at a clinic in Hesperia, CA.

I guess the clinics are breaking the law cause they are out of ordinance and her boss is telling her that he's going to be getting fined 1500$ a day.

I did a lot of research and even watched a 5 hour video on the council meeting that took place in Hesperia and the only thing I can find is that the clinics can be fined UP TO 500$.

I'm thinking maybe her boss is a greedy bastard and is using this to up the prices of meds?

If you have experience with this any help would be appreciated.

um funny that i said this would happen when shit hit the fan to our clinics here in oregon.. i didn't think iy would happen so fast.. it sfucked when one state sets the ways for another state

I've seen this happen many times. Although I've seen clubs over exaggerate their fines too just to be greedy bastards.

It's entirely possible that the club is being hit with multiple zoning violations that add up to $1500 a day. It's equally as likely that her boss is being a greedy bastard.

Wish I could help more, but it's hard with out knowing the specifics of the zoning laws, specifics of the MMJ laws, and the specifics of the building. Almost every commercial building that is more than 20 years old violates multiple zoning laws. The building goes up, the laws change, then the building is now in violation. (not going to read your zoning laws, sorry. paid my dues in that dept already)

My dispensary got shut down by said laws when I said, "no problem, I'll take the fines" and then they went to the landlord and threatened to issue zoning fines every day on all his properties.

They got us on parking limitations mainly. We didn't have a designated space for every 250sq feet. Even though there is absolutely no parking problems in the area, that's $500 per day right there. Sucks to be fined $500 per day, but I could have lived with that. My landlord however could not when they threatened him with that x15.

Local bureaucrats can kiss my ass. So can greedy dispensary owners.

He's being fined for 3 different things, but I guess each fine is 100$.

The code enforcer told him that the fines for each can go up from 100, to 200, to 300 the longer he stays open.
But at the same time everything I've read says they can only be fined UP TO 500$.
He's raised the prices on all the meds by 4$ saying because of this reason.

I'm starting to think he's just a greedy bastard, thank you guys for your time and consideration I appreciate it.
I'm going to get more information, and I actually have a scan of the fine if it would help knowing the actual violations.

Not all zoning fines are for medical. He could be getting one fine of $500 for the non-permitted dispensary, and then 3 other fines for zoning infractions they found. That definitely happens all the time. I don't know if that's what's going on in your case, but it's entirely possible. And yes, him pulling a fast one on you is also possible. Could be that he thinks he'll get shut down so he's trying to make all the money he can while he can.

A business overstating its costs in order to charge its customers more money???Let's be grown ups, folks. Most businesses do just that . With your sittuation it's with fines, with another its their labor costs, and so on. HOWEVER!!!! This is a wee bit different. Part of my duties as the founding member and Preisident of our Collective Association is keeping diligent and accurate records of out costs. These are the life blood of our legal defense. The collective your wife works at is in the same boat. Those records are there. They are probably right out in the open (where they need to be in the event of a raid). Many numbers can be fudged in these records. But, the zoning fines would not be. It is too easy to verify the numbers. So, if it's a big deal to you or your wife, ask him to look at the books. According to our collective minutes, all records can be viewed by all members. (except the master patient list...confidentiality).

I'm not quite sure what your concern is. Is it a moral thing? Are you worried about the store losing business?

I'm worried about both really cause this is a great job my wife enjoys and is happy with.
If they keep increasing fines, and more fines hes going to have to shut down.
But I think hes looking into new places to move to in the area, so things might change.

He'll have a hard time proving "not for profit" without acounting records. These are the dispensaries that are subject to prosecution. Real bummer for you and your wife. Are there any other dispensaires she can apply at? This one seems like a sinking ship.
