Shipping to Self as Patient in CO.

Well, my lawyer is about to smash out my case. The DA tried getting me for shipping two oz's to myself in another state that is medical and failed! The most they can do is possession but I am a patient so, I will keep you all posted on the verdict soon! I should have my 2 oz's back this month! By the way, this is a first and will make case precedent for all future cases! Thought I would share.:mrgreen::blsmoke:

Can you post the case information or at least the jurisdiction ?

Will be interesting to see how crossing state lines factors into this precedence.
What state was on the receiving end ? Was it seized in CO or on the far end?

I shipped it UPS from Loveland,CO going to Las Vegas,NV. Soon as I get everything put together and the case is more complete, I will get it all on here. I was seized here in Loveland because the lady said she thought I may be shipping something illegal. Ind you I look like a normal 30 yr old and packaged it clean, etc.... Just happened for some reason but, my lawyer is all over it and is very confident that it will be dropped! My next court date is on the 12th this month...

I've always wondered what would happen if I shipped some to myself next time I fly out to colorado.

Man I remember the good ol days of learning to ski at lovelad when I was about 7 with my dad. I love that place (grew up in boulder). I always stop by whenever I'm out in colorado snowboardin just cuz it brings back so many good memories.

UPS and FedEx don't follow the same rules that the USPS has to follow re: privacy. NEVER use fedex or ups.

glad to hear it's working out tho bro. besides, you get an extra long cure out of it (as long as they didn't let it mold) ;)

good luck on ur case yo dont take the pleabargin take that shit to trial cause they wont dismiss it till the staert of motions i was one of three people that help change the law for hash in colorado for med pat. cause i was charged with felony possesion of hash and i had a med card but the state of co. didnt have anything for hash as how much u can posses but med card holders in co. can posses hash now with no repercusion and i was acquited from all charges cost about $12,000 in attorney fees my attorney was jason savela

The only difference between ups/fedex and the usps is that the usps has to get a warrant first! My lawyer said no matter how you send it, all carriers have the right to report suspicious packages. Mine was in a manilla envelope all air sealed and what not! I must have smelled like weed or something. Either way, they have nothing on me! My pink slip has no formal charges because non exist for what I did! So, wish me luck on the 12th!

The problem with using USPS is that it becomes a federal crime to ship drugs (although shipping drugs state to state is a federal crime anyway). UPS and FedEx are privately owned and in my experience generally won't prosecute because it costs them too much money. USPS seems to have an obligation to the Fed to prosecute you, although there are some different privacy restrictions. I generally avoid cannabis transactions of any kind with an entity owned and operated by the federal government. Just my two cents.

Hope everything works out Indi. Set those precedents man!

a private corporation very much like Federal Express UPS and the Federal Reserve.
The reason why its a federal offense is because they operate business on a national level,
they are not located in only one State or Jurisdiction.
Thusly any crime or misuse falls under federal jurisdiction.

It is also a federal crime to cuss over the telephone/cellphone airwaves. Class 4 felony.
why? the airwaves are not limited to one state.

That was always my understanding too. At least from a "friend" who used to have baseball size rocks Fedexed to him from Florida in the 80's. I think he was only a friend because I had a triple beam and he needed to do some cutting/weighing. Either way, it worked for me...

Feds only become involved in cases where there are large quantities. In a situation like mine, they are turned over to the state and tried as such! The feds have no interest in a person sending under 2 oz's to ones self. They usually become involved when 1kg or 2.2 lbs and up or 99 plants, but they can get involved in plant counts starting about 49 and up.

Pre trial coming up in two days. Pretty sure they will push it back but, oh well. I aint giving in to the bullshit! Wait until they have to weigh it in court! LOL, when it hits just about 1 and a half ozs they will feel stupid! Cops need to learn how to weigh cannabis properly.

So, pre trial was vacated today. As was expected, I do not go back until Feb. 1st. Think we a filing a motion for dismissal ASAP after I meet with my lawyer and get all the little details worked out. The basis for it is that if you are legally allowed to possess something it cannot be illegal to ship to ones own self. There is some serious technicalities to it that I really can't get in to, but will keep you all posted.
