PHOENIX — State and county prosecutors on Thursday renewed their legal fight against Arizona’s medical marijuana program, asking a court to rule that the voter-approved law is illegal on grounds that it conflicts with federal drug law.

Attorney General Tom Horne and Maricopa County Attorney Bill Montgomery made separate but coordinated requests in a case involving a company’s application to operate a medical marijuana dispensary.
The Republican prosecutors’ requests specifically target dispensary provisions of the state law approved by Arizona voters in 2010, but a court ruling that the entire law is pre-empted by federal law would have broader impact.

The Arizona law permits people certified by doctors as having certain medical conditions to use marijuana. They also can be permitted to grow it unless a dispensary opens in their area. The state is considering applications for dispensaries.

“Possession, distribution and cultivation of marijuana are all forbidden by federal law, and state authorization of these activities is pre-empted,” Horne said.

The case pending in Maricopa County Superior Court involves a company applying to operate a medical marijuana dispensary in Sun City. White Mountain Health Center Inc. sued when county officials wouldn’t provide zoning clearances needed under the medical marijuana law.

The officials had been advised by Montgomery that county employees could face prosecution for aiding and abetting drug crimes.

Judge Michael Gordon recently ruled that state health officials could not decline to award a dispensary license to White Mountain because of the county’s inaction.

In their new filings, Horne and Montgomery asked Gordon to dismiss White Mountain’s lawsuit on grounds that Arizona’s law is illegal.

Horne’s filing noted that he recently issued a legal opinion concluding that the state law decriminalizes possession of medical marijuana under state law. But that doesn’t change that possession remains a federal crime, as are growing, selling and dispensing marijuana, Horne said.

Horne cited court rulings elsewhere that federal drug law trumps states’ medical marijuana laws, but two attorneys for dispensary applicants said other rulings have reached opposite conclusions.

Jeff Kaufman, representing White Mountain, said the prosecutors’ filings target his client’s application but really cast a wider aim.

“I’m sure what they’re trying to do is have the entire law pre-empted,” he said.

Ryan Hurley, a lawyer for other dispensary applicants, said Gordon could agree to consider the pre-emption issue or instead, decide the White Mountain case on narrower grounds related to the zoning issue.

Horne and Republican Gov. Jan Brewer previously asked a federal judge to rule on whether Arizona’s law is pre-empted, but the judge refused, ruling in January the state officials hadn’t established a genuine threat of prosecution of state employees for administering the law.

Also in January, a state judge ordered the state to proceed with allowing creation of dispensaries and lifted some of the state’s restrictions. The state has issued use and growing permits to thousands of individuals, but Brewer had balked at implementing the dispensary part of the law.

They say fuck the Feds for Immigration,....but beg them for guidance in MMJ???

I think this will be my last year in Az.....

Gonna call it now:

The feds are gonna come up with the same conclusion they came up with last time around the block. I expect them to come out with a statement saying that they will not be focusing on prosecuting patients of MMJ programs, but will continue to pursue those who do this commercially.

They can't raid until a dispensary actually starts growing and selling, so by us throwing a hissy fit now, prior to anything illegal happening, is just slowing down the overall process of what will eventually happen.

I got the impression the feds are gonna step in on this one but I guess we will have to wait and see

I still have some hope the Federal hearings to take it off schedule 1 in October will be successful. This will probably be what sets the tone for further mmj prosecution.

Jeff Kaufman IS the client. It's his application under the guise of ELEMENTS. They had numerous apps in and this is the only one they have left. So they are fighting it tooth and nail.

If they don't get this approved then Elements will officially have not gotten any locations approved.

All the dots are starting to Connect...

I am quite certain the Medical Marihuana Act is here to stay... But the same can NOT be said for the Arizona Medical Marihuana Program.

The State can not Authorize something that is illegal on the Federal Books! Simply put!

But the States can create laws that don't prosecute their citizens for the use of Cannabis whether it is illegal or legal on the Federal Books!!

White Mountain should have kept their fucking mouths shut and not tried to put a Dispensary on County Land that was not to have a Dispensary and then sueing over it.

Fuck those guys. They could give a shit less about "The Patients".

Hrm.. I thought these guys were supposed to be anonymous and I thought I heard a couple dispensary owners mention they weren't going to "out" him as the source of the lawsuit. I guess we'll just leave that to Lucius on a public forum lol

Wasn't there a similar hearing in October 2002 and they decided to leave it schedule 1? I wouldn't have much hope for this upcoming hearing, except, wasn't MMJ orignally passed in AZ in 1996 and then overturned by the state gov? Took 14 years to turn that around... so maybe enough things have changed in the last 10 years that the schedule 1 classification will be turned around by the federal gov... we can only hope.

What ever happened to H.R. 2306???

Some municipalities don't even know the winners... Mesa is one of them for sure...
Lots of the cities also have issued use permits (good for a year) prior to the lottery so there is no way to delineate which applicants are winners. I don't doubt some have contacted their city officials but many are still staying below the radar because of Monte and Horne.

I am suprised that they would go against a general vote, I mean if the majority said ok than why would you risk not being re elected by the same maj by going against them? Makes no sense to me at all.
