CA Supreme Court tosses Pack v. Long Beach Medical Marijuana Dispensary Ban

The California Supreme Court dismissed review yesterday of an important appellate court ruling affecting medical marijuana dispensaries throughout the state.

Specifically, the High Court threw out the controversial decision in Pack v. City of Long Beach, which previously held that federal law preempted some forms of dispensary regulations.

The Pack decision has been used by several municipalities, including Los Angeles and Long Beach, to suspend or ban outright the distribution of medical marijuana. However, yesterday's dismissal of the Pack decision throws into question the viability of such bans.

I see dispensaries slowly getting shut down until they are few and far between and then I see Big Pharma or Tobacco popping up and trying to fill the void. Which won't work and we will all just end up where we were before. Growing our own and ducking the Feds. I am not optimistic at all about what the future brings but keep in mind we have been getting shit on more and more over the past few years and I am bitter. LOL
 
Check out the MMJ laws pertaining to Conneticut...talk about strict :( Starting in October, it becomes legal in Conneticut, but there will be no home cultivating allowed and the state is giving only 10 growing liscenses. The only "dispensaries" will be those attended by a liscensed pharmacist. 25,000 application FEE for would-be growers, plus you must have 2,000,000 in an escrow account. Big pharma is already getting involed...mucho dinero in Conneticut.

You guys are old pro's, but just to give you a non-stoner patient's perspective, I was like, oh cool, everything is legit now. Doc's and storefronts, like this plant is finally out of the closet(literally), I started cultivating a few plants just to learn, hopefully later find a strain that actually works for me, most do not, was teaching my daughter all about the plants, their life cycle, the production of medicine... I just thought I could be totally open about it. But as I've been reading recent headlines, it's like it is being turned into an illicit drug again...

This really really makes me sad. Such a helpful plant, so so positive. And I think that is it, right there, you guys talk about big pharma, and some others talk about for profit prisons, and guards unions and the like, but really, seems like the real reason this plant is illegal is because it is so positive, so beneficial, which is antithetical to what our owners want. They want us poor, sick, weak and scared. The more they strive to achieve their ends though, the more they reveal themselves. Will enough people wake up before any type of change is possible? It might already be too late. The Nazi's did what they did essentially with typewriters and guns. Imagine what they could do with supercomputers, automation, remote control...

I'm still willing to bet that when the votes are counted, the feds go away.

Can't believe I actually traveled from state to state working on Obama's primary campaign. I feel pretty f-king stupid about that now. He seemed pretty awesome at the time though...

I am hoping that I am wrong. Votes aren't helping us on the Federal level with this issue. It seems to always be swept under the rug there and left to the local governments. But when it gets too big they step in and push us back a couple years. I do see what you are saying though Dan. Like I said before... I am just too bitter. :D

Well there has to be a reason for all this, they don't do shit like this just on a whim. Must involve campaign financing. But when the election is over, Obama is not accountable to the people paying for his campaign anymore. I think that will end all this nonsense.

If Obama takes a harsh stance on MMJ after his re-election I will be heartily surprised. Anyone remember this photo?obama-joint.jpeg

However, I wouldn't be surprised at all if he takes a more conservative stance in the run-up. California is not a swing state ya?

Dude, this is the worst news I've heard in a while. This is just like tobacco growing! How horrible. We're going to have to fight this shit out west, that's for sure.

To the O.P., this is great news! I live in Long Beach, and we've been worried as hell about the cops ever time we go get our medicine. They have been engaging in some brutal police tactics (smashing cameras, physical violence) but are now just fining the shit out of clubs, like $1200 a day in LB.
