Property owner rights

I am setting up a medicine garden on my property for a friend, who will be growing her own prescription (personal production license - Form F).

My question is, what are my rights as property owner? Am I legally allowed to work in the garden?

I am considering getting my own DG license in order to be safe, any suggestions?

Thanks, cheers!

no legally the garden has to be locked if your friend is only one legal. at least thats how my state is. She needs to be only one with acess. ock it up real good and just get a key..that way if they ever check it out its legit and you dont need to tell them you have a key.

or just get your paperwork done and dont have to worry about any of that crap.

I'm confused by your confusion...if you are the property owner and they live on the land/house and you have given them permission to grow...that's one thing and you would have needed to sign one of your friends forms for personal growing. Then you're okay.

If you are in your own home and you have say a rental where your friend is living like say for example downstairs in a basement suite, then same thing, you sign their personal growing form which says that you are aware that such and such person is growing in your home and you are okay with that. Then I would think you would be okay there as well.

If you wanted to get your possession and your personal growing permits A) Hurry up because you only have less than 1 year until harpers new laws come into effect which are taking away all personal growing rights and making the person needing weed having to go to a commercial grower who will charge them up to $8 a gram. B) You need to get yourself a condition that warrants the use of medical marijuana. Many threads about that and there are also many threads about doctors to go and see. They will charge you up to $500 for prescriptions up to 20 grams a day. You can find such doctors by searching on google as well using search words like...doctors that prescribe medical marijuana in Canada...but keep in mind the processing time is 2-4 months. It varies.

My best advice about you in the garden (Is this a greenhouse for all year growing or for just the summertime) is to call a criminal lawyer and ask them.

But if you are not a designated grower and they aren't growing their own weed, this might put you in trouble with the law and if it is over 6 plants, that could be a problem for you so I would seriously put in a phone call to a criminal lawyer about this...

The property does not have a house, just an outbuilding that will be used for growing. My friend lives elsewhere and would be there part time for the work, and the rest of the time I would be tending it. On paper, she will be growing for herself on my property, but in reality, I will be doing much of the work. Sounds like I should be a DG as well and run another prescription at the site. I have other people interested, so getting another license is not a problem, just the higher overhead, output, and responsibility that comes with it. Thanks.

If this is a green house grow for year round and in ontario. I can help with costs if i can run a script there.

As the home owner you have the right to access to your property. With it being a legal grow if you are ever caught in the act, so to speak, all you would have to say is your checking on your building or property.

They would not have a case because you have the right to be there.

Good Luck

Thanks. Also wondering about the risk of having a friend stop by to check on things and do some watering occasionally. While technically illegal, is it something that people have been in trouble for? Do people get busted for tending someone else's crop?

Also, how many growers can you have on a property? I believe you can have 4 licenses (some sites say 3?), but could you have four different growers?

Two growers for a maximum of four patients per property. More people that know about the grow exponentially increases the chances of problems and getting ripped off. Personally I think the only people that should know you're growing would be you and the person you're growing with/for. Realistically that is too many.
