In a case freighted with major constitutional implications, a federal appeals court on Friday overturned President Obama’s controversial recess appointments from last year, ruling he abused his powers and acted when the Senate was not actually in a recess.
The three-judge panel’s ruling is a major blow to Mr. Obama. The judges ruled that the appointments Mr. Obama made to the National Labor Relations Board are illegal, and the board no longer has a quorum to operate.
But the ruling has even broader constitutional significance, with the judges arguing that the president’s recess appointment powers don’t apply to “intrasession” appointments — those made when Congress has left town for a few days or weeks.
The judges signaled the power only applies after Congress has adjourned sine die, which is a legislative term of art that signals the end to a long work period. In modern times, it means the president could only use his powers when Congress quits business at the end of a year.

Never mind that these appointments have been blocked by Repubs and are not likely to be settled any time soon, crippling the government - oh, I forgot, that is what you folks want so that you can claim that govenemrnt doesn't work in the first place.

The dispute was over whether the Senators were on recess or "pro forma" session (1 Senator shows up and bangs a gavel to an empty room every couple days) and the appointments in question were to the National Labor Relations Board. The reason the lawsuit started was because the appointees were deemed "too pro-union." The reason the appointments were made while the Senate was out of town was because they blocked every candidate the President nominated. Get ready for more gov't backlog (or a Supreme court ruling).

There are checks and balances to the US government.

The senate has the right to stay in pro-forma session even if it is to block recess nominations to the labor relations board. The president cannot simply unilaterally decide to go around them by making recess appointments when the senate is not formally in recess.

The court of appeals was right and the supreme court will uphold it. The Obama administration's problem is that the NLRB no longer has a quorum. So, if they want to fight it out, he is not going to be able to pass any legislation through that body that will stand in court.

It wasnt a dispute, the president acted unconstitutionally...

It wasn't just Obama who acted unconstitutionally. Under the court's decision 285 recess appointments made between 1867 and 2004 would be invalid.

They been trying to cripple the NLRB for decades. Cant have a national labor relations board looking out for the peasants you know

You don't appt while they are out for a day or two. That is not a recess. Sorry. Illegal is illegal.
