Yes that's pretty much possible and done daily, sensi e.g. registered / trademarked their stuff (like Northern Lights® e.g.), but they didn't ever infringed someone as far as I know..real breeding in the sense of selecting, crossing, backcrossing whatever is complicated and there are a lot of "breeders" just taking strains and crossing them with each other.
Others try to infuse landrace genetics from seeds they obtained all over the world, but mostly everything is some kind of recombination of the most basic lines in cannabis:
Northern Lights, Haze, Skunk.
This simple "pollen chucking" needn't even be bad, take the caramelo e.g., it is a cross of 2 exceptional phenotypes of lavender from soma seeds, which is known to have quite a few different expressions of plants.
You can say someone saved you a little selecting, if you want. If you like the selected end result caramelo that is, of course.
