there is 4-1 pts -CGs in Michigan....demand far outweighs supply...

wonder where a lot of these pts are gonna have to get their meds now??
cgs are now a premium....I would say make sure all your pts are CGs for 5pts....all of them

and i would change my stance and not frequent places where open sales are permitted....FM...CC...dispensaries...

I called a few dispensaries around town just now and informed them of the decision-most said Didn't know about that but we aren't fucing closing until they close the doors for us. Most seem to think that leo won't enforce it-at least around here. I get the feeling without anyone saying it that the places in Jackson concentrated in blackman twshp have talked to the local LEO before they set up and that there is a sort of agreement going on that you don't fuck up and we won't fuck with you. it's just the feeling I get and growing up here knowing how shit works in this GIANT small town. I think it'll have to be state cops acting on orders from someone pretty high up to shut the doors in jackson. Now is the time to show your support. I have always said that the dispensaries take a huge risk for us, the patients, and should be comended for being open. I know everyone hates the percieved price gouging but truth is they make around 10% to cover employee paychecks and overhead and they can get a huge dick should the state decide to fuck them. I want to live in a world with farm markets AND dispensaries so I support them both. I don't talk negative about the prices at either places and the quality of meds offered. Let's get behind them now that we all feel like we could lose them. I have overages monthly but I buy from the dispens and the market just to be a part of it. RESPECT to all the owners standing up to the bullshit-stay open PLEASE. We need them. gripes aside, we need them.

BTW Has there ever been an attempt to bring any of this legislation, enforcement or politicians in general up on "Public Nuisance" charges?!?

so....all this shit and the court ruling OK'ed sales and made a dispensary a noise violation? When you boil it down....nah I'm still super-pist fuck that LOL! but the stakes seem quite low unless your the owner that is putting $ into making your place look great and a local asshole in a blue shirt wants to fuck your day up and make you move out.

when ive held the door open for known police officers going into a dispensary, im not to worried yet. i personally know 3 cops that have there cards and rage on this topic just as hard, if not harder than us. if there bosses found out they'ed be done for. not talkin rookies either, and with respect to them i wont say what counties. just thought that was important, are fight isnt with most police, its with these asswhole reps that wanna fuck us over. there should be a new thread with all the shitty reps and there emails so we can all complain in mass. same with the good ones, they need to hear we appreciate them too.

I think the games these SC justices foresee will take place in the civil courts post "Public Nuisance" violations.

well now that I have the perspective of what is at stake here (noise violation for good golly goddamnit) I can more easily see officers NOT raiding a joint. now a sale or manufacture of narcs or drug dealing (which sales seems to be OK'd in this same ruling taking that shit off the table for the prosecutors) would be attractive to prosecutors and LEO because they get proceeds cash and the like to keeep as a parting gift esentially but I don't think they can take your car for having loud music......just me thinking here.

From what Im getting and then referring back to the laws actual language, it wont be a simple local violation. Instead the nuisance violation negates you legal protections under the mmj law because your stepping outside of how they interpret the rules and enforcement segment of the law.


So the next step is getting the Republican led legislature to amend the law and dictate what kind of businesses are ok. Wont hold my breath.

Got to agree, there are very limited crimes and convictions that negate a defense. I'm going from memory, not looking it up again right now but they state that in the act I believe.

After reading through the court decision I interpreted it as the actual sale itself (p2p or dispensaries etc anything outside of your state registered patients) being the public nuisance. Not the public nuisance being a separate charge.


to clarify a little further the term public nuisance refers to the violation of the mmj law things like holding more then what was needed for a caregiver and his/her patients, how transfer is interpreted and so on.

I think this will come down to an additional tool that the local town/cities/townships etc will use to close the books on the moratoriums (sp?) they put in place to keep the shops from opening, and also for the towns/cities/townships to close the doors on the ones that were grandfathered in before everyone put in place the freeze on new shops. I highly doubt that places like Ann Arbor and Ypsi will force them to close after they went through the work of licensing and all the legal framework.

I do wonder if the whole craigs list and bud trader thing will go away...I sure the heck wouldn't want to be advertising after this ruling.

Correct. The MI SC found that a local municipality lawfully shuttered a MMJ facility simply under the guise of "Public Nuisance". In turn we will now see many other local municipalities with this same motive do the same. But not all will or would even consider doing such a thing to their citizenry.
