House lawmakers have approved legislation to significantly reduce statewide marijuana possession penalties.
House Bill 465, sponsored by Rep. Emily Kane (D-Albuquerque) seeks to decriminalize adult marijuana possession offenses, eliminating the possibility of a jail sentence for those who possesses eight ounces ounces or less of cannabis. Those who possess less than four ounces would be subject to a civil fine and no criminal record. Under present law, possessing marijuana is a criminal misdemeanor offense punishable by up to one year in jail and a $1,000 fine.
On Tuesday, March 12, House lawmakers passed the measure by a vote of 37 to 33.
The measure must now be acted upon by the Senate. If approved by Senate lawmakers, the measure would go before Republican Gov. Susana Martinez, who has previously expressed opposition to liberalizing marijuana penalties.
