The SC announced last week that it will hear the appeal in Ter Beek. There were plans in motion to challenge these restrictions. With the announcement, those plans had to be put on the back burner.

And the City of Wyoming lost the case in the Court of Appeals. It was ruled that the ordinance is void and unenforceable. That court overturned the lower court ruling. Ter Beek, the patient/plaintiff, won.

Ter Beek was planned to be used in our approach toward Flushing, yes bucky. Jeff did very well by the AD, and we hope to see more cases succeed

I am no lawyer. Just any another magic clown. There are no credentials, and no lofty accomplishments.

I cld see charging a cost for Caregivers looking for a new Patient, but just no fees for Patients. I know a few months ad are already free, but there's still a dis-incentive if a fee is @ the corner. That really should be adjusted. Make it as easy as possible for patients to seek CG opportunities. who's gonna fix thAt? Props for wiping thee bogus zoning committees

Medical marijuana rules would keep plants away from Zeeland Township schools, churches

ZEELAND TOWNSHIP, MI – Officials in Zeeland Township are considering a medical marijuana ordinance that would give township officials the ability to respond to complaints about potential abuses of the state law that legalizes its use for medical purposes.

The Township Board on Tuesday, April 16 approved the measure for first reading, with a second vote planned for next month.

The proposed ordinance is largely based on the existing state law, except it does include provisions that prevent marijuana from being grown within 1,000 feet of a school, church, day care or park. Michigan voters passed a ballot proposal in 2008 that legalized medical marijuana.

Zoning Administrator Don Mannes told board members that he doesn’t expect the ordinance to add much in the way of workload for him.

“The only time we’re going to enforce it is if we get complaints, and we’ll send a police officer there and find out whether he’s complying with the ordinance,” Mannes said.

Trustee Ron Brink expressed concerns about the lack of specific language regarding how the ordinance will be enforced.

“It doesn’t smell quite right,” Brink said. “There’s nothing that says ‘where’s the long arm of the law.’”

However, Mannes says as the township’s code of ordinance already states that the zoning administrator has the responsibility for enforcing all township ordinances.

Trustee Ed Zylstra favors the measure because of its simplicity.

“It’s not complicated. We don’t need anything complicated,” Zylstra said. “If marijuana gets legalized in the future, why spend a lot of time on something like this?”

Township officials approved an 18-month moratorium on medical marijuana in 2011 because of what they saw as “ambiguity” within the state law. The township Planning Commission has been worked on an ordinance for several months, said Treasurer Al Myaard, the Township Board’s liaison to the planning body.

The admin permits one post at no cost. Afterward, ads are six bucks for a week, and ten for a month. Paid members get a month free. It costs to run the site and to do the necessary work.

Kormon is the site owner. He frequently posts blogs for the membership and guests, sometimes working them with the media, local and national. His guy Zap is a great admin. There is a Thursday nite online radio show to boot.

It will not be until the SC rules in Ter Beek that any real progress can be made on these issues. It might be possible to stand them down without that ruling. With the latest decision going against municipalities, it could work. The Court is to rule whether municipalities can write and enforce these things. The standing COA ruling is that they cannot.

This will work in Zeeland, or anywhere else in the state where an ordinance is coming on line. It requires local residents to take action. The threat of having to hold an election brought on by this move may be enough to make the local government rethink the issues and see their error. If not, put on your walkin' shoes:

MICHIGAN ZONING ENABLING ACT (EXCERPT)
Act 110 of 2006

125.3402 Notice of intent to file petition.Sec. 402.
(1) Within 7 days after publication of a zoning ordinance under section 401, a registered elector residing in the zoning jurisdiction of a county or township may file with the clerk of the legislative body a notice of intent to file a petition under this section.
(2) If a notice of intent is filed under subsection (1), the petitioner shall have 30 days following the publication of the zoning ordinance to file a petition signed by a number of registered electors residing in the zoning jurisdiction not less than 15% of the total vote cast within the zoning jurisdiction for all candidates for governor at the last preceding general election at which a governor was elected, with the clerk of the legislative body requesting the submission of a zoning ordinance or part of a zoning ordinance to the electors residing in the zoning jurisdiction for their approval.
(3) Upon the filing of a notice of intent under subsection (1), the zoning ordinance or part of the zoning ordinance adopted by the legislative body shall not take effect until 1 of the following occurs:
(a) The expiration of 30 days after publication of the ordinance, if a petition is not filed within that time.
(b) If a petition is filed within 30 days after publication of the ordinance, the clerk of the legislative body determines that the petition is inadequate.
(c) If a petition is filed within 30 days after publication of the ordinance, the clerk of the legislative body determines that the petition is adequate and the ordinance or part of the ordinance is approved by a majority of the registered electors residing in the zoning jurisdiction voting on the petition at the next regular election or at any special election called for that purpose. The legislative body shall provide the manner of submitting the zoning ordinance or part of the zoning ordinance to the electors for their approval or rejection and determining the result of the election.
(4) A petition and an election under this section are subject to the Michigan election law, 1954 PA 116, MCL 168.1 to 168.992.

This is not by and/or for 3ma, but the entire medical cannabis community. I have no position with them other than as a member, just as are supercro and ozz. There are people who say the same about this site. You let it get under your skin, or not.
