california took my plants

i drove into cali today in a 17' uhaul.

dude at the border who usually just asks if you have any fruit or produce asked me very casually if he can take a look at what's in the back.

i stupidly said go ahead. he had the latch opened before i realized i should have just said "not without a warrant" and been on my way.

first thing you'd see if you opened the thing is a huge citrus meyeri plant. the second thing you'd see is the grocery bag full of weed and a bong.

he comes back around and says "we've got a problem.....you need a certification for that citrus plant".

LOL!

so because i was stupid and let him open it up, we had to drag that huge plant out of the truck and put it next to the incinerator. i said "nothing about the weed?"

his reply: "welcome to california"

guess that wasn't his jurisdiction

The police don't need a warrant to search a vehicle. All they need is reasonable suspicion.

Obviously he had none so he asked.

You know once you legally consent to a search you can revoke the consent at anytime.

I know that feeling. Years ago I got pulled for an out head light at dusk. I had just picked my buddy up from work. Cop asked if there was anything in the car that shouldn't be. My response was "not to my knowledge sir." He really didn't like that answer and reasked again and added "what do you mean by not to my knowledge?"
I said "To my knowledge at this moment there is nothing illegal in my car." My buddy got a little lippy and I immediatly apologized for his actions and told the cop I understand he is just doing his job. Got a ticket and went on my way. 10 minutes later my buddy throws out a quarter of weed on the table when we got home. I was pissed, told him to never open his mouth ever again if we got pulled over!

That is what reasonable suspicion is. Or a higher level of probable cause.

Reasonable suspicion applies for things like burglary tools, smell of marijuana, seeds and or stems and or spent shell casings.
Suspicion that a crime has been committed or is currently being committed.

Oh and obviously you lose the ability to revoke consent as soon as they find something illegal.
