I foresee a huge settlement check going in this guys bank account.
That being said, poor bastard was violated, and I bet they didn't even spit first.
Tis fucked up.

So when your wife is dead from a drunk driver will you still protest that drawing the blood of the driver is violating his liberty?
They used to just give you a DUI and take your license if you refused to blow but strapping you down and removing a part of you is much more humiliating and dehumanizing.

sounds like a great way to make a couple million bucks for just a few hours of work. Some people pay big bucks for that kind of humiliation and ass play. Win/Win !!!

If I read things right on a legal forum, the most he could get is $600,000 under NM law.

Agreed.

Can't beleive how far some police departments and others will take things now a days.

Little off topic here (sorta)

In my area there was a state trooper who killed his wife 10 years ago. He was just caught this year. He has been a cop all this time and no one knew a thing. He was caught because he told his girlfriend what he did. She in then turned him in. The investigation was reopened and he now stands trial and is currently locked up for it.

Shows the type of people we deal with and the things we have to deal with. corruption and law enforcement that cant even follow there own laws.

I can go on and on. But just sickens me when I see stuff like this. And these are the guys we are suppose to call when there is trouble. I have always handled my own problems. I will always keep it that way.

Headline pedantry... Man was unlawfully sodomized (the use of the word literally is ambiguous and, in most instances, redundant. Also, dude lacked equipment for rape. BUT, he WAS sodomized, without his consent and under threat. Still makes it a 1st degree criminal sexual Contact.

That said - I think the Albuquerque Metro-Detention Center gang pods are safer than dealing with the outlying cops in this state! Some scary shit happens. (knew a guy that wound up having his weed and coke charges dropped -- because when it came time to for defense to weigh and test the evidence, there wasn't any left.)

this is sooo fucked up. However much he gets is still not enough. I would ask for nothing but to be allowed to have bubba the male nurse perform enemas and do cavity searches on each and every one of the offending "officers" and doctor

course this'll never happen. these fucks stick together.

So when your wife is dead from a drunk driver will you still protest that drawing the blood of the driver is violating his liberty?
apples and oranges guy. The man ran a stop sign..no one was hurt.

Good ol' NM, lol.

The southwest corner is one of the worst, too.

Grant county has massive problems with meth and has been ranked in the past as having "the most 'alcohol related incidents' per capita in the entire country", yet they have an abundance of LEOs (city, county, AND staters) that sit around because they "have nothing to do". It's even worse when they harass innocents out of boredom (witnessed it many times).

Id be so fucking sick if I was that guy, I mean, damn. Not just once, but repeatedly raped and then forced to watch people play with is shit. I mean, these are some sick fucking people involved in this, and legal or not doesn't change how crazy this is.

No legal system on earth would bring me any amount of justice for such acts. I wouldn't even press charges. I'd be out for blood because this isn't just doing your job, and you don't just forget about something like this.

Get a DUI and lose your license for killing someone while drunk driving? You think that is more just than getting a warrant to have blood drawn and tested for evidence?

Exactly. Completely different situation that I believe demonstrates that forcibly drawing blood can be appropriate.

I've always wondered about cop's jurisdiction in parking lots. If you get into an accident in a parking lot, from my experience the cops refuse to get involved unless something else criminal was going on. If it's strictly traffic related they say it's a personal matter to be dealt with by the participants and their insurance because it is private property. I have always taken this to mean that they don't/can't enforce traffic laws in parking lots. How can you be allowed to ticket someone for running a stop sign in a parking lot, but if that same car hits another car because of it you can take no action because it is "private property"? Never made sense to me.

That's what I mean. This case in particular was outrageous and uncalled for. I wouldn't damn the whole system because of these rogue cops.
What about the cops who did vaginal and anal searches on the side of the highway, to a woman and her niece because they committed the terrorist act of flicking a cig butt out the window? AND used the same glove to check all four cavities, which could've ended in disease for either girl. Or the NYC cops who anally raped the guy with a mop handle? I'm sure google could turn up incident after incident. It's how shit is now, it's not isolated. Cops are scum.

All for running a stop sign!

The news says the drug dog might not be certified and might be a pet.

The hospital has sent him a $6,000 bill. Now that would more than piss me off.

Lawyer says the Hispanic police might not like a white boy living in their area.

From the us news.
Hidalgo County Sheriff Saturnino Madero did not return a U.S. News request for comment. Deming Police Chief Brandon Gigante declined to comment on the case when reached by KOB-TV on Monday, simply saying, "We follow the law in every aspect and we follow policies and protocols that we have in place."

Kennedy filed a motion for summary judgment Oct. 24, asking the court to rule on the facts of the case, which she says are not disputed. She says defendants responded by expressing interest in resolving the case outside of court.

He didn't use his blinker and it got him an anal search. Tim Young had no drugs, the police said the non-certified alerted (the dog is known for false alerts). They took him to the same hospital too.

Sounds to me like another lawsuit. And just how many other people have had this happen in that N.M. county?
