Well like i said... im from a "commonwealth state" (google it ) and the laws are much stricter... right now im in the south, and for example, maitence is ALWAYS coming over to spray something or check something. And if im not home when the pest guy comes over, he'll come in anyway, and leave a little green paper saying...

Yeah, well, so I did, and it seems you're a little mistaken on a couple oc counts. A state calling itself a commonwealth versus a state versus a republic has absolutely no bearing on these laws. What does have a bearing on the toughness or strictness of your state's laws are your state's voters.

It is not right for a landlord or an agent of the landlord to let themselves into your home any time they wish without proper notice. I have been a tenant and I have been a landlord so I've experienced both sides of the coin. Any state that had language in their laws allowing such a thing would immediately be challenged as unconstitutional, I believe it violates the 4th amendment of the United States Constitution. Not even U.S. territories can enact such laws (Puerto Rico, Guam, U.S.V.I.), as they are patently unconstitutional. Knowledge is power, my friend, don't let them tread on you. I understand that you don't want to rock the boat, but that can lead to trouble if you're not fully aware of your rights.

I know that you're in one of only four states. I'm guessing you're either in Kentucky of Virginia, because those other states are Yankee states (damn Yanks). I was born in the south, and my father's family has roots that go back to before the union.

So, if you're in Kentucky, the same laws apply.
If you're in Massachusetts the same laws apply.
If you're in Pennsylvania, guess what.
If you're in Virginia same thing.

My 2 cents.... You will have to deal with this as it is 2 seperate cases.
1st case is with the police, entering your home illegally with out a search warrant. first off they cannot get a search warrant on hear say, even with the pictures provided by your landlord which they knew were taken illegally. In order to get a search warrant the officer needs probable cause, meaning he himself would have to suspect somthing. The notification of the police by your landloard has nothing to do with the case.

2nd case is with your landlord obviously. I know in some places, by law they must give you a 24hour notice prior to entering your home, occupied or not. The facts are that she first knocked.... juggles the door knob then enters proves she was making sure you were not home before entering, it sounds pretty bad for her case, you can have a lawsuit if you pursue, she will also lose her job and possibly evicted if she lives in the apartments. If you do go get yourself a good lawayer you may come out ahead on the landlord case, but it will cost you on the police case.... its a catch 22.... Just cough up the cash and get a good lawyer.

I was seething with anger when I read that she let herself in into YOUR apartment, and took pictures of YOUR stuff, regardless whether or not it's weed, it's YOUR shit. That is some bullshit, I don't know why people are saying don't use the video, it seems like that's perfect evidence of the landlord breaking the law(?) and intrusion of YOUR privacy. It seems that anything that ensued afterwards should be thrown out of court and deemed obtained illegally.

...then again, the same American court awards people who spill hot coffee on their own moron selves millions of fucking dollars. The same courts fault the owner of a dog that bit his neighbor AFTER the neighbor repeatedly shot the dog with a BB gun. The same courts give money to fatasses who devour mcdonalds 3 times a day and then sue MCD for it. The same courts award money to people who sneak out the back window of a bar to avoid the bill and break their teeth when their drunk ass fell from it. Or place the blame on the automaker when the driver crashed his newly acquired van, put it on cruise control and went to the back of the car to lay down...
