Any lawyers? need help

im from illinois, and was caught with 17 grams of weed. a class c misdameanor. the circumstances was that i was driving someone elses car, the weed was in the trunk. i was not aware that there was weed in the car.

i was pulled over because i forgot to turn on the tail lights. once pulled over was asked for liscence and insurance. after supplying them with all adequate information, i was asked to step out the car. then they asked me to search.

they asked was it mine and i denied. anyway i have no criminal convictions what so ever.i was thinking about getting a lawyer. does anyone have experience in this or can help me with some advice? thanks

did you tell them yes they could search the vehicle? were you dui?

Yeah...I've been locked up 8-9 time juvenile / adult.
Well u probly have a. "Simple possession of marijuana" it be nice if u listedur charges.
But you'll recive 30-90 days in county/probation 6months/price which stands for pre-trial intervention. No time its like probation. Drug test,meetings,staying away from every thing illegal pretty much.in return ur charge is dropped forgotten never to return.
But I failed price violated probation and was in prison for 18months

IF you're pulled over for a moving violation...hell if you're pulled over for anything you never consent to a search at any time. You're pulled over for a tail light that is functional? they dont need to check the trunk, thats just the pig bonus for the 10% of the time they find something someone forgot about and said "yeah go right ahead" like a chode. Don't let them search if they ask...let them break the law then get the case thrown out.

I recently caught a possession charge in California for having less than 28 grams. The judge is allowing me to either provide him with a certificate that I took a marijuana class or my cannabis card (I have to renew my card it was expired at the time) and he'll drop the charges. I would do something proactive, at least enroll in the class if your state doesn't support the medicinal use of mj, the judge will like that and should drop the charge.

yes he did ask to search the car and i did consent but only because i wasnt aware that anything was in there, besides if i did deny there goes the dogs and i would have been locked up anyway. plus it wouldnve looked like i was guilty.

Also do u know if pending charges show up on backgrounds checks?

NEVER EVER CONSENT TO A SEARCH!!
Especially since it was not your car, you don't know what the owner has in it.
It was your own fault you got nervous and let them violate your personal space. I suggest you read up on your rights a bit.

my suggestion is get a lawyer. and ask them. I know since it wasent your car and you had no knowledge you might get a plea deal. but as it is you are only talking misdemeanor.

see if you can plea down to 2gram or less go find, call dui lawyers and see if handle minor drug possession charges, or try to get a public defender and try to convince them to let you take the lowest plea.

If they got a drug sniffing dog out because you said no, that is not enough for probable cause, and if the dog was busy you would have been set free.
if it comes up again simply say, not unless you have a warrent, and follow it up with if you are going to waste my time I am going to waste yours.

thanks everyone. everyone is telling me dont worry. now had it been in the chi, i would have cared less, but i was in skokie (a chicago subburb) and everyone says they are stricter out there.
im in grad school working on my masters and got called back for an interview so my main concern is that it will be on my background

Depending on the state.. I know in michigan if you have no prior charges it's a $500-1000 fine
& one year advisement/ not reporting probation. If you keep you nose clean for one year it is
gone from your public record.
( However you will still have a record that the police can access which means they won't need consent to search if there is a next time)
Pending charges do not show on a public record.( Innocent until proven guilty )

Checks show if you were a suspect for a crime others only show convictions. Just depends the army,military

cut the guy some slack about consenting to a search. i am from illinois too. probable cause can be anything that gives police a reason to susspect anything, like it took you to long to pull over, or the vehical smells like smoke!(weed or no) just about anything they can pull out of their ass. the not concenting and warrant loophole does not work any more, not since like 2004. they don't even have to ask concent any more in il, though most still do. the warrant/concent is still needed for a locked glove box/trunk, any area visible from outside is fair game to them, wether you like it or not. this is comming from an illinois state trooper(not me). i hate illinois, 2nd worst state for a motorist. good luck buddy, court supper vision is likely if you haven't been on it for at least a year. mine was for a year, no piss test like with probation. show up to your plea hearing and most likely the prosecuters will give you a plea bargain(plead guilty and they give you supervision, after your term is up you end up with a conditionl discharge and a clean record). ive done it more than i can count on my hands. all illinois wants is money, jump through the hoops, pay your fines and let your A-hole heal.

skokie is still in cook county man. like i said it will be a light fine and court supervision or a lil probatrion, and misdeaner probation in cook county is a joke!!!

If the vehicle belonged to someone else, and the weed was locked in the trunk out of your sight and control a decent Lawyer will get you off.

just make sure to get a good lawyer and by that i mean a lawyer who might know the DA. my lawyer talked to the DA about lowering my felony to a misdameanor before i even showed up to court. do some research dude, i was fortunate enough to know a cop, and the cop reffered me to this lawyer, i know how that sounds (a cop reffering me to a lawyer) but he is a family friend that hapens to be really cool lol unlike most other dick hole cops

everyone, thanks. my fault i been gone for a minute doing research about lawyers. ive googled them and its so many, that i dont know what the fuck to do... then on top of that, i only got a stack to spend on a lawyer. i even looked in the high times magazines but they seem very iffy. so i guess its looking like spnding money on a lawyer and spending extra money on expungement. im not guilty cause i didnt even know it was there, but i dont wanna take it to trial cause i might lose. plus i aint got the extra cash to take it to trial.

Im not tryin to cop out and i dont want it on my record. i'll be graduating this year and i dont want to have to go thru 6 years of college to not be able to have a job. oh and not to mention the loans i have to pay off. wish i had some law books right about now.
