I was asking myself the same question: How can I grow 6 plants but yet only be allowed to possess 1 ounce??? It makes no friggin sense!
So I was looking at "Arizona Laws & Penalties" under NORML's State Laws page, and there it says under Penalty Details:
"
Manufacture/Cultivation
Voters in Arizona passed
Prop 207, a statewide ballot initiative legalizing the possession, use, and commercial sale of marijuana for adults. Adults may cultivate up to six plants for non-commercial purposes in a private residence. The law took effect on November 30, 2020.
Producing 6 plants and up to 2 pounds of marijuana is a Class 5 felony, punishable by a minimum sentence of 6 months, a maximum sentence of 2.5 years, and a minimum fine of $1000 or a fine to exhaust the proceeds of the drug offense. If probation is granted after conviction for this offense, the offender will face a mandatory sentence of 240 hours of community service.
Producing between 2-4 pounds of marijuana is a Class 4 felony, punishable by a minimum sentence of 1 year, a maximum sentence of 3.75 years, and a minimum fine of $1000 or a fine to exhaust the proceeds of the drug offense.
Producing more than 4 pounds of marijuana is a Class 3 felony, punishable by a minimum sentence of 2 years, a maximum sentence of 8.75 years, and a minimum fine of $1000 or a fine to exhaust the proceeds of the drug offense."
So... WTF? The way the proposition reads is confusing enough, but after reading this penalty info, it reads like I am allowed to grow up to 6 plants but I am not allowed to possess more than 1 ounce of weed. So what happens when I harvest? Even if I grow one single plant, I can get almost a pound of weed, so now it's a felony to harvest it. That's ridiculous!
Does anyone have any better insight on this? What am I missing?
TIA.
