that judge is in a coastal area north of sydney, he is universally loathed by all who live in that district, when i first encountered him i was warned by people he was very severe in sentencing for even small issues, i dismissed that info as BS thinking most judges these days only send people to the cage for serious offences...well not this guy, i took my wheelchair bound elder female buddy to court that day & witnessed firsthand that total asshole of a magistrate in action, even waiting for her case to come up i sat in the courtroom and watched with growing trepidation his ugly attitude to anyone who puts a foot wrong
They can be cunts but there is sentencing guide lines they have to stick with otherwise they are leaving the door open to appeal from either side
Not to mention the justice department uses gaol as a last resort due to a few reasons one of those being over crowding. The newspapers and talk back radio would not let a 75 year old lady get gaol time for under 49 plants and under a kilo. (its 50 and a kilo for gaol time in NSW as far as I'm aware??). In fact they probably wouldn't let her get gaol time if she was over those on a first or 2nd offence.
Enhanced cultivation( indoor ) law i,50 and above is deemed commercial there is no mandatory minimum, 500g of anything leaf,stem indoor or outdoor buds is also deemed commercial and no mandatory minimum,you can still be charged with commercial offence if you have less than those numbers but intent must be proven by the prosecution.
