CANADA GROW LAWS: how are they defined

Hi all. I am looking for information on the exact details of the law regarding growing and possession in Canada.
They information online is murky and ill defined. this is what I have so far:

It is a mandatory 6 months in jail for growing 6 plants: "Canada’s new law provides a mandatory six-month jail term for growing as few as six marijuana plants, twice the mandatory minimum for luring a child to watch pornography or exposing oneself on a playground."

But I also hear tell of this sketchy worded 5 plants = 5 months.

so which one is it?

what are the consequences for growing 4? 3? 2? 1?

Are there other tagged on charges if you have a certain amount stored on top of plants?

I keep hearing this "didn't you know? It's the LAW!" ringing in my ears, but I swear to gods they just want to surprise you with some ludicrous bs.

A law that gave more time for less plants would be a joke. You wont get 5 years for 5 plants and only get 6months for 6 plants. The info on the 6 plants is correct though.

Its up to the courts and your previous record. If you were doing to haphazardly or in a school zone/around your kids where they had full access. Category 1 or 2 conditions that doctors have denied on getting you a medical license would help your case.

As with the other it depends on other factors. But having a 1/4lb with no bags or scales that make it seem as if you were selling.

The police are not going to draw a line in the sand and say "Hey fellow canadians, if you have 4 or 5 plants and your not selling then its ok we wont arrest you". If you are worried about getting caught dont grow. If you do grow keep it below 6plants, dont tell a soul (seriously this is how you get busted by wanting to puff your chest out and say im a grower), dont keep any bags or scales and use a 600-1000w's in total for your grow with good odor control. Dont go smoking outside either or letting on to anyone that lives around you that you smoke it.

I am going to keep looking for whatever specifics I can. If anyone has any more on the matter or some personal experience please post up

What strain misquoted your first stat... lol 5 months he said man.

Mashpotato. Mandatory Minimum Sentencing is a pretty self explanatory term. It means you WILL get sentenced 6 months for 6 or more plants.

As for less, it depends if they try your case as an indictable or summary offence. Indictable being worse, but you can check out the Controlled Drugs and Substances Act For more info.

I never would've thought Canada of all places would've ended up going backwards with their marijuana cultivation prosecutions. I do know that if Canadian law enforcement goes forward with that, they are going to be kept BUSY and their prison system is going to start expanding FAST. I remember seeing some marijuana documentary where someone in Vancouver , BC said that it was estimated that 1 out of 5 houses in Vancouver have a grow and you could tell this in the winter time by which house had a grow because the houses that had no snow on the roofs were the one's with grows. There are A LOT of growers in Canada.


Traditionally, the Canadian justice system has always been relaxed on cultivation sentences compared to the US. It's a bit of a shock that they are now going to take a “get tough” stance on marijuana growing. I don't think at this point it's going to change Canadian grower's minds. They may scale back from doing large for-profit grows to personal-use closet sized grows, but I don't think the majority of Canadian growers are just going to stop growing and begin buying from the licensed MMJ Canadian grow facilities. It's a rip off. Canadian growers aren't going to start paying big money for their supply when they've been growing their own for more than 10 years.


I don't see any of these new Canadian laws on home growing lasting. I think it will be short lived from public backlash and the amount of money for prosecutions. It's really too late for the Canadian govt to try and pull this off at this point. This is all corporate driven behind the scenes for profit making. Legalization is coming, both in the US and Canada. I don't see any govt being able to set up a system where possession and use are legal but home cultivation is kept illegal for the corporations and govt to profit from.


With 1 out of 5 people growing in Vancouver , with many more cities and towns all over Canada, nah, these new cultivation laws in Canada will be very short lived. There aren't enough prisons in Canada to hold all the growers.

Don't sweat these new laws, go stealth, grow smaller, but wait and watch for these news laws to get over turned.

The law is this......6 - 199 plants gets you 6 months mandatory sentance but IT HAS TO BE FOR THE PURPOSE OF TRAFFICKING.

if you already had a prescription for 30 plants,then they would have to prove you were trafficking,to enforce the mandatory sentence, is what was meant.
6 to 199 is an arbitrary amount......
the best way to interpret this is to grow 199 plants,and don't get caught...lol its called maximizing the minimum

Harper and his cronies are building super jails to put all of us pot smoking criminals in. That's why he implemented the mandatory sentencing thing. The reason that the manditory has yet to be implemented: public opinion. The majority of Canadians believe that marijuana should be legal. With the federal election looming, Harper has laid off. Get out and vote Liberal people. The liberals have said they will legalize it!!!! Our votes can not only take the wind out of the Conservatives sails, but, can indeed sink the ship.

The liberals said they want to to legalize and tax the shit out of it.
But politicians say one thing and do the opposite all the time.
Its rediculous....
A couple weeks ago i was at a friends house doin dabs and we thought it would be funny to call and ask the cops. What the exact laws were right now and she said..."im not sure but i think its decriminalized. You could always go downtown to the law library and look it up!"
Lol even the cops dont know whats going on anymore.
