Caregiver Questions ?

If I become a caregiver and have five patients, is it legal in the state of rhode island to sell to those five patients even though i am suppose to be growing for them not to make a profit for myself?? I mean its not free to grow , so it should be legal to charge for meds right? Also, if I am a caregiver can i legally under mmj law in RI sell to other caregivers and patients or is this illegal? Because what else am i suppose to do with overage? If you grow you know its near impossible to get only the legal limits of 2.5 oz per patients? Jw if anyone can clarify this up for me. Feedback is much appreciated thanks.

I was also wondering if i have overage am i suppose to throw it out or something? lol i know it sounds ridiculous to even ask the question but what if someone gets suspicious and the cops come in to count plants and all that good stuff and they find a pound jarred up in stock ? I would be going to jail. So i guess i am just wondering why we are allowed to grow it if we are not allowed to posses it ,even if it is for medical purposes?

No profit doesn't mean you can't be compensated for your time. If you are over you risk arrest. You have to figure out what to do with dry Meds, wet Meds don't count toward your limit.

What about selling it to other caregivers or patients that are in the program and in need of meds? is that legal in ri mmp program or is that risking arrest as wel?...ooh yea and i had a couple of dispensary ?s if you could tell me anythong about that like how to get in and sell to them or make ''donations'' to themand how that all works assuming my meds are qualified for them to sell there?

If i could sell my overage to the dispensary that would be awsome. Then, i could be compensated by my patients for all of the legal limts of 2.5 oz each patient. Is there a time limit to how often you can sell your patient the 2.5 oz?? I just want to be 100% legitimate. I am not some greedy kid that wants to be a drug dealer. I am just a kid who knows how to grow and wants to make a difference in some patients lives with quality meds for fair prices to make a little change on the side. That is not hurting anybody, is it? Also, don't want to go to prison as well.

Lol, no offence but just take full day and read the ri laws a hundred times... you will answer your own questions. You can take a donation from your 5 reg patients only.Cannot take donations from anyone else legally. Your overages you can sell to dispensary an he writes you a check... its then your choice if you pay the taxes on it ect. This isnt something that can be explained in one paragraph and everyone has different views on it. Gotta do what you think is legal based of the laws written...

finally, yes if cops do come in and jars of weed of there they most likely open and put on a digi then when over 2.5oz limit your fucked... i remember a bust in west warwick and they found lollipops and make a big thing about it. So do not be suprised if they find a way to charge you for edibles towards your 2.5oz.

i was going to say the same judging by the questions.no better place than to read the RI laws MJ act.if you are still confused there are RIPAC orientation meetings that you could attend to answer all your legal questions.

i know most of the laws the only real question i had about them was selling to other patients but thanks for answering it for me that's what forums are for to ask questions instead of reading something that i know most of 100 times...and for the pound of overage laying around i obviously knew it would make me plausible to arrest i answered my own question if you read closely i guess i was just asking because it is near impossible to grow under the limits and wondering why are we allowed to posses so little but thanks for the feedback anyway

Didnt mean anything negitive or mean... just that ri has all grey areas and laws are very vague an puts cardholders at risk of being arrested. So tread carefully. If anything isnt clear that doesnt mean its ok to do oposite cause they looking for anyway to catch someone out of there line.

ok thanks...I have been finding that out slowly but surely lol, a lot of the laws are very nondescript and leave you wondering. I would love to get into the dispensary though. From what i have read on this site i saw someone post that they are taking 2k a pound. I would take the price cut to become more legitimate no? i mean your still at risk of feds or irs taking your money though, how do you feel about the whole thing?

I was also wondering about selling back to a dispensary. One of my fellow caregivers inquired, and they pay $200/oz. No more than that, but then they sell it for $$450?? I thought they were a n0n-profit? This is Rhode Island, the crookedest little state EVER.... so obviously I would have an issue letting them double their money on me. I didnt become a care giver to get rich. I have some good friends, and my sister who suffers in pain daily. As opposed to having her addicted to pain pills, which was the case, I decided I would try to help her. Back in my younger days, I grew guerilla style, and was very successful. The laws say 3 different things regarding plant count, seedlings and dried product. The copy i keep handy 15 plants in flower, 12 seedlings (and really small seedling or clones are exempt from count) and 5 ounces dried product. I could be wrong... but I plan to keep a really low profile, and i would never have a reason to travel with more than an ounce. As long as my license is posted at my grow, and i don't make any waves... I will do fine. The key now, as it was 10 yrs ago when i grew.... Tell no one. 5 people knew then. 4 know now.... my .02

NOT TRUE..As long as it is NOT a drug felony charge FROM RI.your good to go.

The RI Law does not specify the maturity of the plants that are subject to count. In other words, the law only states that you must not exceed 12 plants, regardless of maturity and/or root production.

III. Limitations & Protections
A. Possession and Growing Limitations
The MMA allows qualified patients and their primary caregivers to collectively possess twelve (12) marijuana plants and up to two and one half (2.5) ounces of usable marijuana. The plants must be grown/stored indoors.
"Usable marijuana" means the dried leaves and flowers of the marijuana plant, and any mixture or preparation thereof, but does not include the seeds, stalks, and roots of the plant.
The primary caregiver shall not possess an amount of marijuana in excess of twenty-four (24) marijuana plants and five (5) ounces of usable marijuana irrespective of the number of qualifying patients to whom he or she is serving.

For some people it's not about getting rich its about getting meds to patients.

Your selling meds for 2k then they sell them for 5-6k lol... someones getting rich before it get to the patients
