Conspiracy to traffic what is currently a controlled substance.
Remember it’s been pounded into our heads time and time again, “the law is the law as it is now“. Writing up contracts to export medical cannabis to other legal countries is one thing, but there’s nothing legal about recreational cannabis in Canada yet! As long as people are still being charged with possession and trafficking recreational cannabis...why not conspiracy to do the same?!?!
Conspiracy to commit a crime needs mens rea to have value, there is no criminal intent if the contract is explicitly only valid in a legal context. I'm sure a lawyer would be able to explain it better but there is clearly no intent to break the law as the system is rigged to their advantage.
I'm sure most pharmaceutical companies start working on marketing/distribution while their drugs are working through being regulated. This is no different if you presume legalisation is inevitable, at least their form of legalisation. It doesn't mean it's right but business doesn't operate in a vacuum. Some always have advantages because of their positioning.
Which is why I think there's more value is focusing of forcing the gov to create fair micro grow regulations so that the entry point for the legal market is accessible. If underground growers had the chance to compete against the LP's I have no doubt they'd beat them out.
