The commander in chief has all of the executive authority of the executive branch of the gov't. The DEA and HHS are both parts of the executive branch and all of the authority necessary to reschedule cannabis under the controlled substances act fall under these two departments. Therefore the commander in chief has the authority to reschedule cannabis.

I can pretty much just keep repeating it because I'm right and I win.

In fact I'm double winning because you are defending Obama.

DEA HHS the FDA, and DOJ are in fact part of the executive branch, but Barry doesnt have the power to reschedule cannabis by fiat.

even if he did have that power under the laws (which he dont) he doesnt have the (Plenary or Moral) authority to do it.

Barry Seotoro couldnt command a dog to heel, much less ride herd on unwilling mandarins, to force them to do as he bids.

also, if calling Barry ineffectual is "defending" him, then i guess i am defending that incompetent buffoon

a president with balls would keep sacking the chiefs of the HHS, DEA, DOJ and FDA until they did as commanded, but Mr Seotoro lacks the prunes for that course of action

He reversed Congress' vote on the Dream Act by fiat. He illegally appointed party minions to office without the consent of Congress. He ignores the law.

Technically both sides are right and wrong.

For Obama to reschedule, he would have to compel someone else to actually do it.

That person (s) have been pointed out by Doer and Dr.K.

The point, legally Obama cannot do it.

In practice, if he wanted it done, it would very likely get done rather quickly.

But the proper legal channel for this is not executive order, but regulating agency decision.

Therefore, I judge Doer to be more right here than abandonconflict.
