Dept of health website on 25 mile rules

I can't huff and puff enough on how fukkked up the dept, of health website is on the 25 mile rule.

Here is the link to their page with questions on the matter:

So I'm looking for a new patient outside the 25 miles, but first I have to pay them their $200 fee, tax or whatever they call it, then they will tell me if the patient is 25 miles away from a dispensary.

CB13: Where can I find a list of operating dispensaries?When a qualifying patient application is approved, the list of operating dispensaries will be included as an attachment in the approval email that is automatically generated from the system. ADHS cannot provide the list of operating dispensaries by any other means (A.R.S. §36-2810(A)(2)).


Nothing is said about returning the $200 fee and my guess is good luck getting it back.

I can look at leafly and weedmaps and determine it myself, but I have NO idea if a new one has just been approved next door to my new patient or not...totally insane that dispensary locations are top secret unless you pay them $$$ and qualify.

You could always use the AZDHS address checker. From what I understand its the based off of the day of application. So as long as there wasnt a dispensary open that day your good.

P.S. Feel free to PM me if you know any extra paitents. I'm on the search myself. Haha

Wow, that is bullshit.

There whole system has been down for the last 2 weeks, it's ridiculous. Then they tell you to email support, who in turn tells to call a woman named Melissa, who goes on to tell you that the system is down and to check back later this week?

ORLY? Go fuck yourself!

Aren't these fucks sitting on several mil of our $$$ from cards and applications? And they can't even get their goddamn act together!

I am pretty sure there is a dispensery in eloy. That would be within 25 miles of san tan and queen creek.
I also know that one is opening in Mesa next month.

The above comments are the point. The dept of health is stalling and know which areas they have approved that could open any day. Unless you troll news feeds and forums like I do you don't know when or where the next dispensary is popping up. Wayyyy to confusing for an ole guy like me )

One is opening in East Mesa by June. Hurry and get your renewals. This one and the one in Glendale almost overlap, basically eliminating everyones grow rights in the whole valley.

Did they just open?

I just got a new patient with grow rights not even 3 weeks ago in the Queen Creek area.

I'm guessing those D's aren't technically operating yet, otherwise don't know how I got that patients grow rights through Feb 2014.

no they should be opening shortly. i went by and saw their retail today actually. once they open i predict you will get something ni the mail changing the date on that card you got. happened to me for a patient when glendale opened.

I just submitted my paperwork today and I live in San Tan Valley and I checked-off the box to cultivate.
AZDHS sent me an email acknowledging receipt of my payment
with NO denials so-far of my request to cultivate!
Since in live in San Tan, in Pinal County,
I'm well-outside 25miles from the nearest dispensary.

LOL, dude what are you even talking about... you are grandfathered in until next renewal.

So you are predicting? Or did it actually happen? Cause I call BS.

Straight from the horse's mouth, you keep your grow rights until next renewal.

On the dept of health website FAQ section for caregivers there is NO mention of the grandfather clause: http://www.azdhs.gov/medicalmarijuana/faqs/index.php?pg=caregivers but in typical Govt. confusing language and websites somewhere I've seen in Humble's blog or on same page somewhere on the site that growing rights for caregivers extend to the expiration date of the card. After 20 minutes of searching for the link, I can't find it...

found it on Humble's blog: "By the way- AZ now has 3 operating dispensaries, one in Glendale and one in Tucson. Another dispensary in Cochise County opened today. Because of the 3 operating dispensaries and provision in the voter approved language that only people that live more than 25 miles away from a dispensary are authorized to cultivate, more than 70% of Arizonans now live in areas where self-cultivation will no longer be permitted. However, we’re grandfathering the cultivation rights for current card-holders until they renew their card or move into an area that’s within 25 miles of a dispensary."

I found the answer to your question -
ARS 36-136(F)
Authorizes the Director of the Department to "make and amend rules necessary for the proper administration and enforcement of laws relating to the public health."

The Director has the power to amend the rules set forth by AzDHS but not the AMMA itself.

The 25 mile radius rule is nuts from this outsiders point of view, and would be cause for relocation if faced with such a joke of a law
