I think the only patents will be for things like complete resistance to specific pathogens and other practical things.
I read this morning over 90% of tomatoes in the shops lack a gene that makes them tasty... now that they know about it, it is only a matter of time before we get awesome tomatoes from the stores.

We may not get them (the great tasting tomatoes of old). Folks that knew great tasting tomatoes and lament their demise are old and dying off; and younger people don't really have a perspective as they grew up with the durable tomato of today; developed to enable machine harvesting.

I might add: you want great tomatoes, you have to grow them yourself.
Yeah, that's not working out really well for me.
