"Mandatory minimum punishments will also be introduced for the production of cannabis (marihuana), with their length depending upon the number of marihuana plants produced.
(62) A main argument in favour of mandatory minimum sentences is that of incapacitation. The idea behind incapacitation is that separating offenders from society prevents them from re-offending. It holds out the promise of guaranteeing that the person will not commit crimes against the public while in custody: the longer violent, repeat offenders spend behind bars, the fewer crimes they commit.(
83) This incapacitation is, therefore, thought to contribute to public safety., and any of the health and safety factors also apply. If the number of plants produced is more than 200 and fewer than 501, the minimum term of imprisonment is one year, which increases to 18 months if any of the health and safety factors apply. The minimum term of imprisonment will be two years if the number of plants produced is more than 500, which will increase to three years if any of the health and safety factors apply."
Also, the maximum sentence for any cannabis offence will be doubled from 7 years to 14.
